Obvious Suspect Finally Arrested in Mysterious Parking Garage Disappearance of Perky Texan Christina Morris

Back in late October, we reported on the mysterious disappearance of Christina Marie Morris, a perky 23-year-old Texas woman who was last seen heading into a parking a garage in Plano, Texas at around 4 am after spending the night partying with friends. She was accompanied by Enrique Gutierrez Arochi, a young man she knew slightly from high school, who had spent the evening with her and her friends and volunteered to walk her to her car in the covered parking lot.

aaas11Two things add a kind of bitter poignancy to Christina’s disappearance; first, she had always been deathly afraid of being abducted since she was a young child; and second, the only reason Arochi walked her to the parking garage in the first place was because she had gotten into a fight with her boyfriend via text messages and had decided to drive directly home to Fort Worth, presumably to mend the fences, instead of spending the night at a girlfriend’s place which had been her plan prior to the argument.

aaas7Oddly, Christina’s silver Toyota Celica was not discovered there in the parking lot until four days after she disappeared. As the last person seen with her (he was caught on surveillance video entering the garage with Christina), Arochi was  interviewed by the Plano police whose spokesman David Tilley made the following statement at the beginning of the investigation:

“They walked into the parking garage and, according to him, they split and went in opposite directions,” Tilley said. “He said he went to one side of the garage where he was parked and she went to the other side of the garage, where her car was parked. A lot of people have said that is not the case – what he is saying is not correct – but we don’t know. We don’t have any evidence to support either way.”

aaas15At that time, Tilley stated that Arochi was neither a suspect or even a person of interest but that no one had been ruled out.

At that time, we wrote:

Something fishy here and I suspect the police know full well that something’s fishy. They, however, do not have sufficient evidence to arrest Arochi or even lean on him hard, not yet.

Well, the police continued their investigation, working slowly and carefully, and on Saturday they decided it was time for the big shoe to drop.

 

David Lohr of the Huffington Post writes:

aaas12A former high school classmate of a missing Texas woman has been arrested in connection with her disappearance, more than three months after the woman vanished from a Plano parking garage.

The Plano Police Department arrested 24-year-old Enrique Gutierrez Arochi on Saturday and charged him with aggravated kidnapping in the August disappearance of 23-year-old Christina Morris, police said.

Now that they are confident that they have at least some of the goods on Arochi, the Plano authorities are being quite forthcoming and it appears that they may have both direct and circumstantial evidence linking Arochi to Christina’s disappearance.

“The basis of this arrest stems, in part, from the results of DNA samples that were collected,” Plano Police spokesman David Tilley told The Huffington Post.

aaas2Although the police initially refused to tip their hand and admit that “the long arm of investigation was draped firmly about Arochi’s shoulders,” we now know that an affidavit for a search warrant to scour Arochi’s 2010 Camaro contained plenty of damning information including the following details:

1) The affidavit alleges that when interviewed “Arochi made false statements about when he parked his car and the details surrounding the last time he was with Morris.”

2) The affidavit further alleges that one of Arochi’s co-workers told the police that Arochi “had visible injuries when he came to work on the morning of Aug. 30.” Given the fact, that Christina disappeared around 4 am that morning, combined with the strong probability that other individuals who had spent the evening with Christina also underwent police interviews, it seems virtually certain that if asked, they would have reported that Arochi had no visible injuries when he and Christina left the others and began walking to the parking garage. This information would have glaringly contradicted what Arochi told his co-worker who told that police that “when he questioned Arochi about his injuries, Arochi said they occurred during a fight on Aug. 29.”

aaas14Oh yeah! Our boy Arochi playing fast and loose with the timeline will prove to be his undoing. In addition to the above evidence, the police also eventually obtained “surveillance video from a convenience store that was taken on the morning of Aug. 30,” which shows Arochi wiping down his passenger-side door and the back of his vehicle. Arochi was a busy beaver on the morning of Aug. 30.

“Arochi has intentionally made false statements which have hindered detectives in locating Morris,” the affidavit alleges.

Although the police didn’t admit that Arochi was a “person of interest” early on in the investigation, it appears that certain members of the media found him to be singularly interesting and in an interview with ABC affiliate WFAA, he claimed that 1) Christina Morris was never in his car, and 2) he had nothing to do with her disappearance.

He actually had the gall to state, perhaps cavalierly:

“I feel like they’re wasting their time on me when they could be looking at someone else that’s actually the suspect or the person who actually did it.”

aaas13When the search warrant for Arochi’s car was granted, the police took DNA samples and collected other evidence that was sent out for testing. Although by this point, Tilley appears to have said plenty to satisfy the public, he did add the following details:

“There are other factors beyond the DNA that allowed us to get that search warrant, and we’re not releasing those details,” Tilley said. “They did a lot of testing and they gathered a lot of evidence … and all of that has been sent off for testing.”

In addition, Tilley suggested that they were holding back considerably more information and that there was still “a lot more work to do.”

There certainly is. Meanwhile, Arochi’s bond has been set at $1 million and he’s being held in the Colin County Jail.

aaas4It’s very possible that once he and Christina were alone, Arochi decided that he was going to attempt to take her in the Biblical manner with any and all necessary force. Keep in mind that he was very likely intoxicated. Christina appears to have objected vociferously – thus, Arochi’s visible injuries. I like to think that this perky and spirited young woman put up a damned good fight, but notwithstanding me cheering her on, it seems pretty clear that he ultimately overpowered her. What happened next is unknown. Christina’s mother desperately wants to believe that Christina is still alive, even if it means she  has been sold into prostitution. I am less optimistic and although I certainly hope I’m wrong, I suspect that our “creep of the week” raped and killed this unfortunate young woman.

Kidnapped Louisiana Mother’s Family Kills Abductor in Daring Vigilante Rescue!

Opinions differ as to the validity of vigilante efforts in criminal matters and — for the most part — it’s probably a good thing that non-law-enforcement personnel are typically not in a position to mete out justice. Last June, however, in a rural area of Lafayette Parish, La., it was the family of kidnap victim Bethany Arceneaux, 29, of Duson, La, that rescued her from her abductor, Scott Thomas, in an abandoned house on the edge of a sugar cane field after law enforcement had searched for her fruitlessly for nearly two days. This is yet another true crime story in which the facts could easily be poured into a captivating crime novel.

beth4The family of a kidnapped Louisiana mother tracked down and killed the father of her child in the abandoned house where he was allegedly holding her prisoner, authorities said.

Bethany Arceneaux, 29, of Duson, La., was abducted in the parking lot of a daycare where she was picking up her 2-year-old at approximately 5 p.m. on Wednesday, Lafayette Parish Sheriff’s Department Captain Kip Judice told ABCNews.com.

Witnesses saw the suspect, Scott Thomas, allegedly force Arceneaux into his white Buick LeSabre, before driving off…

Although they were not married, according to Captain Judice, Thomas, 29, of Leonville, La., was the father of Bethany Arceneaux’s child. As a result of relationship problems, Bethany filed a police complaint on June 15, claiming Thomas locked her in a house and threatened to kill both her and her son. A protective order against Thomas was issued June 17 and Thomas was arrested on Aug. 8th, and later released, for violating the order.

At the time of the abduction, Bethany’s child was left behind in her car at the daycare center. Bethany’s mother arrived later and was allowed to take the child home with her. Meanwhile, the search for Thomas and Bethany kicked into high gear. Later that evening, law enforcement officials found Thomas’ car near an abandoned sugarcane field in a rural area of Lafayette Parish, La.

beth8One of Bethany’s shoes was found in the Buick LeSabre; the other had been left in the parking lot of the daycare center.

After locating Thomas’ vehicle, the authorities searched the sugarcane field Wednesday night and all day Thursday, but to no avail. The sugar cane towers two feet above a typical man’s head and it was brutally hard for the rescue team to fight their way through the dense cane.

It wasn’t until Friday morning that a break came resulting from a determined search mounted by Bethany’s own family members. They came upon a secluded, abandoned house behind a cluster of trees directly across the street from the field where Thomas had abandoned his car. According to Captain Judice, only the home’s roof was visible from the road:

“[The family] converged on a piece of property about a mile from where the car was found. One of the family members heard what he thought was a scream.”

Arceneaux’s cousin (it is unclear whether he was the family member who heard the scream) then approached the home, kicked in the door in and entered. There was Thomas holding the beleaguered, and considerably the worse-for-wear, Bethany captive. At the sight of her cousin, Thomas began stabbing Arceneaux, and a confrontation ensued.

“The cousin, who was armed, began firing several shots at Thomas,” Judice said. “After a couple of shots, [Arceneaux] was able to get free of him and they escorted her out of the house.”

beth6Meanwhile, officers who heard the gun shots fired surrounded the home. Upon entering, they found Thomas, who had sustained several gunshot wounds, lying lifeless on the ground.

Arcenaux, who had suffered multiple stab wounds, was transported by ambulance to Lafayette General Medical Center, where she is in stable condition.

Oddly, Captain Judice — in what would appear to be pre-autopsy protocol — stated that Thomas’ cause of death is not known. The captain also stated that Thomas did not own the abandoned home.

truckBethany, who was extremely weak and had not eaten or drunk anything since her abduction on Wednesday, told investigators that the home was the only place she remembers being held hostage.

Unsuprisingly, no charges have been filed against the cousin who shot Thomas, and according to Captain Judice, it is unlikely that the man will be charged:

“In the state of Louisiana, you have a right to protect yourself and others from imminent bodily harm. We believe at this point, based on evidence and statements collected, that this guy was acting in defense of Ms. Arceneaux and thus, was within the state law.”

Carol Kuruvilla of the New York Daily News writes:

beth3The family has been praised for their actions, but the case has also raised questions about why the police were second on the scene. Bethany’s cousin, Dawnetta Roy, found it “upsetting” that her family had to find the missing woman themselves.

But Cpl. Paul Mouton, a Lafayette Police Department spokesman, said that police were on the hunt as well. He claimed it was coincidence that the family found Bethany first.

“While we were looking on one side, they were looking in another and they came upon her. It just so happens where they were looking was where she was found,” Mouton said. “If we weren’t looking at all and they were searching, that would be different.”

“I’m so happy. God is good,” Monica Arceneaux-Henry, Bethany’s aunt, said. “We followed our faith and believed she was alive. God answers prayers.”

Although I’m not generally an advocate of vigilante justice, which all too often can deteriorate into mob violence, in this case it seems that it was both effective and necessary. Although some readers will no doubt feel that he had it coming, we’ll never know for certain, however, whether the shooting of Thomas was actually necessary.

A Trio of Celebrities Who Would Be Seriously Punished for Their Crimes Today

The world has changed greatly since the 1960′s and — generally speaking — individuals are held to a much higher standard of conduct with respect to sexual “indiscretions” and other form of blatant or serious criminal misconduct. In this post, the facts of which are provided by  Lachlan M. and Javier Yepes at Cracked.com, we cover three celebrities who “got away with murder”, figuratively speaking, in previous decades, but would probably get far more than “a slap on the wrist” if they were apprehended for these crimes in today’s world.

We will start with legendary rock guitarist Jimmy Page before moving on to Vince Neil of Motley Crew and —surprise surprise — Sean Penn.

 

Jimmy Page Kidnapped a 14-Year-Old Girl and Kept Her Prisoner for Several Years

jimIn addition to his fantastic career with Led Zeppelin, Jimmy Page turned in a monumental body of excellent studio work in the mid and late ’60s. He played on Tom Jones’s pop smash “It’s Not Unusual”, The Kink’s monster hit “You Really Got Me” and Van Morrison instant ’60′s classic “Gloria”, before going on to stardom with Led Zeppelin.

According to Lachlan M. and Yepes, in 1972, Page was hanging around a nightclub and laid eyes on 14-year-old Lori Maddox. Page sent roadie Richard Cole to Maddox’s table with the message, “Jimmy told me that he’s going to have you whether you like it or not.” The roadie then grabbed her and chucked her in the back of a limo.

From there, it was on to Page’s house, where the “affair” was quickly consummated. Page may have been sleazy but he was not unintelligent and he knew that if the word got out, hejim3could be in serious trouble. So for the next few years, although Maddox reportedly traveled with the band at times, she was kept out of the public eye as much as possible so that the relationship wasn’t brought to the attention of the authorities. Even in the wild ’70′s, you could still go to jail for something like this.

Page got away with it and never went to jail or got arrested. Lori Maddox may still be infatuated with him and calls him “romantic.” Perhaps this is a case of the Stockholm syndrome. Here are Maddox’s own words from Hammer of the Gods: The Led Zeppelin Saga:

 “It was magnificent. Can you believe it? It was just like right out of a story! Kidnapped, man, at 14!”

 

Motley Crue’s Lead Singer Vince Neil Killed Someone While Drunk Driving and Only Got 30 Days in Jail and a Large Fine

According to Wikipedia, Motley Crue has sold 90 million albums over their 30-year career. Known and loved for their hard rocking and hard-partying ways, the Crue consumed enough cocaine to put dozens of cocaine dealers’ children through college

jim4Their shenanigans were so over-the-top crazy that it made them caricatures but no one seemed to care. After all, it was the hedonistic ’80s. But not everything they did was lovable. Certainly not the time they killed  a man.

On December 8, 1984, lead singer Vince Neil was enjoying day 3 of a three day party at his Vegas pad. The booze was running low so he jumped in a car with his rocker friend Razzle and drove to a liquor store. Out of control crazy, he soon lost control of the car and collided head-on with a Volkswagen coming the other way. Razzle died instantly, and the two people in the other car were hospitalized. One reportedly suffered brain damage and was comatose for a month.

Neil was convicted of DUI and vehicular manslaughter, which could have resulted in up to 10 years in prison. Being a superstar, Neil hired a “weasel lawyer” and paid him a lot of money. The lawyer talked the sentence down to 30 days in jail, five years’ probation, and $2.5 million in fines. Neil only served 20 of those 30 days because Motley Crue had a tour scheduled.

To his credit, Neil certainly realized how fortunate he was, stating:

“I wrote a $2.5 million check for vehicular manslaughter when Razzle died. I should have gone to prison. I definitely deserved to go to prison. But I did 30 days in jail and got laid and drank beer, because that’s the power of cash. That’s f_____ up.”

It is noted that Neil’s contrition has not stopped him from driving under the influence on one of more occasions since then.

 

Sean Penn Tied Up and Physically Abused Madonna

Sean Penn is one of our most well-respected actors. Who can forget his roles in “Milk”, “Mystic River” and “Dead Man Walking.” He is also a noted progressive who vehemently opposed our involvement in the war with Iraq.

Madonna and Sean Penn, 1986Therefore, it’s easy to think of him as not only a fine actor but someone who cares about humanity.

In Penn’s earlier years, however, he was known for his violent and aggressive outbursts. The incident that could have resulted in severe repercussions including substantial prison time was the time he assaulted and battered Madonna in 1988.

Their marriage was a stormy affair and Penn’s heavy drinking certainly didn’t help. Finally, in 1988, after he flew into a rage over Madonna’s supposed affair with Warren Beatty, she called the marriage off. Penn responded by turning into an abusive nutcase. Although accounts of the beating vary with respect to details, here is the story according to Lachlan M. and Javier Yepes:

jim7After he got good and drunk (again), Penn climbed into Madonna’s house, where she was alone. He then grabbed her, tied her to a chair, and assaulted her for hours, both physically and emotionally. He then went out for more booze, came back, and kept up the beating. Madonna only escaped after telling Penn that she had to go to the bathroom, which meant he had no problem battering, beating, bloodying, and bruising the supposed love of his life, but felt it would have been too degrading to make her pee in front of him.

While Penn was arrested, the charges were dropped because Madonna didn’t want to generate a media circus, which may have been the one and only time in her life that Madonna actually wanted the press to go away. A couple of decades of political activism and two Oscars later, and the world barely remembers an incident that would turn most people into a pariah.

In today’s world, any of the above three incidents would result in some serious prison time. For kidnapping and carrying on a sexual relationship with Lori Maddox, Jimmy Page could easily get 20 years or more in prison. For his DUI vehicular manslaughter, Vince Neil would probably be looking at two to three years minimum. As for the violent Mr. Penn, he would be lucky to escape with a year’s county time, depending on whether the authorities wanted to make an example of him.

Feds Will Not Seek Death Penalty in Angela Johnson 5-Person Methamphetamine Revenge Killing Case

According to Newser, executions in the U.S. are at a 20 year low. The news service informs us that The Death Penalty Information Center, which is a nonprofit organization that opposes executions and tracks the issue, reports that so far this year (and the year is drawing to a close) 35 inmates have been executed in the U.S. and 71 have been given the death penalty. We have to go back 20 years to see lower figures; in 1994 there were 31 executions nationwide. And the 71 death penalty sentences meted out this year is apparently the lowest number in the last 40 years.

aan11Thus, this is good news for those of us who generally oppose the DP. On the other hand, those of us who believe that justice is exemplified by following the “eye for an eye and tooth for a tooth” dictum can find consolation by checking the numbers in 1999, the year in which executions in the modern era (since the DP was reinstated in 1977) peaked with a whopping 98 folks being executed and 277 being sentenced to death.

Therefore, if we break down the figures, we see that about one-third as many folks were executed this year compared to the peak year 1999, and only about one-quarter as many were sentenced to death. However you look at it, this is a big decrease.

In my own criminal defense work, I work mainly on Federal cases which means I draw mostly drug cases and fraud cases (with an occasional sex case thrown in for the sake of nausea). What this means is that there are very few federal capital cases; murder and its first or second cousin, manslaughter, is almost always prosecuted at the state level.

aan3There are certain exceptions, though, which generally occur when a federally prosecuted narcotics cases also includes murder(s) or some form of drug-related fatalities, and these cases can trigger the death penalty. One of these cases occurred in Iowa in 1993 when an Iowa woman named Angela Johnson helped her boyfriend Dustin Honken, a Mason City, Iowa methamphetamine kingpin, kill two former drug dealers, 32-year-old Terry DeGeus and 34-year-old Gregory Nicholson, who were cooperating against him with the Feds; Nicholson’s girlfriend, 31-year-old Lori Duncan; and Lori’s two daughters, who were 10 and 6 years old, respectively.

Ryan Foley of the AP describes how Johnson played an integral role in bringing the murders to fruition:

Prosecutors said Johnson posed as a saleswoman to get into Duncan’s home days before Honken was to plead guilty to drug charges. Honken and Johnson forced Nicholson to make a videotaped statement exonerating Honken, then took him, Duncan and her children to a field where they were shot in the back of the head, according to prosecutors. Months later, Johnson lured DeGeus, a former boyfriend, to a secluded location where Honken shot him and beat him with a bat, prosecutors said.

The victims’ bodies weren’t found until 2000, when Johnson, then jailed on drug charges, drew a map for an informant to a shallow grave near Mason City.

Thus, we see that Johnson played a key role in all of the killings, acting as the lure to draw the victims into Honken’s murderous net.

Although the state of Iowa does not have the death penalty, in federal cases the prosecutors have discretion to seek it in extreme cases, and in 2002, they announced that they would be seeking that punishment for Johnson.

After Johnson was convicted at trial of being Honken’s accomplice in the slayings, in 2005, a jury handed down four death sentences, giving her the decidedly dubious honor of being the first women to take her place on federal death row in decades.

In March of 2012, in what could be seen as a rather surprising development, “U.S. District Judge Mark W. Bennett overturned Johnson’s death sentence” on the grounds that at her trial, her lawyers “failed to present evidence about her brain and personality impairments that could have been mitigating factors.”

This meant that her case had to go back for re-sentencing and set the stage for a new round of arguments from both sides. In an effort to make a powerful pitch on Johnson’s behalf, her current lawyers, including death penalty specialist Michael Burt of San Francisco, “met with the Justice Department’s capital review committee earlier this year to try to persuade them to back off their pursuit of capital punishment.”

Their strategy was essentially three-fold. First, they stressed “that many of the victims’ families didn’t want to go through another hearing.” They also pointed out that Johnson wasn’t the shooter. Lastly but perhaps most importantly, they explained that “expert testimony developed after the trial shows Johnson suffered from a brain disease that impaired her ability to weigh actions and had mood and personality disorders.”

By making their pitch, Johnson’s lawyers essentially volleyed the ball back into the prosecutor’s court, leaving it up to them to either agree to a life sentence, or to continue to argue for the death penalty, thus sticking to the guns they’d been firing since 2012.

aanOn Wednesday of this week, perhaps to everyone’s surprise, the U.S. attorney’s office in Cedar Rapids announced in a court filing that they will be abandoning their pursuit of the death penalty, which means that Johnson, who is 50 years old, will be sentenced to life without parole.

Angela Johnson is currently serving time at a federal prison in Carswell, Texas. According to Attorney Michael Burt, she reacted with “immense relief and gratitude to the government” after learning about the decision.

“I can’t say enough about how much I respect Judge Bennett and the government for realizing this is not a case they should seek death in,” said Burt. “It’s really remarkable that they would reach that decision.”

aan2What this means is that in this case the Feds, who are generally tough as nails – as I know so well from dealing with them for the past 11 years – especially in really serious cases which this obviously is, have chosen to be content, however grudgingly, with a sentence of LWOP for Ms. Johnson.

Thus, they appear to have raised a weather finger to see which way the wind is blowing, and upon realizing that the wind is definitely blowing in the direction of fewer death sentences, they have chosen – at least in this matter – to join this trend.

I’m very aware that many of the individuals that read this crime blog will be horrified to see that Ms. Johnson’s “judgment day” will come at the hands of a higher power than the federal government, while other readers will salute this decision as a harbinger of a day — in the perhaps not too distant future — when our nation makes common cause with those nations all over the world who have chosen to relegate the death penalty to the dustbins of history.

 

Chicago Woman Buried Alive in Nefarious Funeral Parlor Murder Plot?

Perhaps you’ve toyed with the idea of murdering your wife or husband. After all, no one can deny the fact that our partners do offend from time-to-time. Of course most of us manage to salve our battle wounds and make up with our spouses whether we want to of not. But suppose you can’t? Suppose you have no choice other than to murder your “better half”? How do you do it?

prem5Actually, it’s simple but only if you run a funeral parlor. So if you’re not an undertaker, you might as well forget about it (and whatever you do, don’t make the mistake of hiring someone to do it for you. It never works out the way it’s supposed to). If you are an undertaker, however (and I say with a straight face that I’ve always wished that a malign fate had smiled more kindly upon me and made me an undertaker), you have a fighting chance of murdering your significant other and getting away with it.

prem4At least it is rumored that Harold Lynch, the alleged funeral director of the Thomas Hites Funeral Home in Chicago, thought the odds were in his favor of murdering his wife and getting away with it based on a seemingly foolproof plan he’d cooked up.

Of course, to execute his scheme, he needed a cooperative third party – in this case a dead client, which is a commodity funeral directors can typically obtain without much difficulty.

A Chicago family was grieving the loss of their son, as they said their final goodbye’s at his funeral.

prem6Then something strange and unnatural happened, something so macabre that the grieving family no doubt thought they had been transported into some awful Edgar Allan Poe story. One of the grieving family members, who reportedly wishes to remain anonymous, recounts:

“We decided to stay for a bit after the funeral, to let it all sink in. When all of a sudden we heard screams, but we could not figure out where they were coming from. We realized it was coming from under the grave where we just laid my brother. We ran and got help.”

As fast as their legs could carry them, I might add.

Other witnesses apparently corroborate that it was approximately 15 minutes after the body of the boy was laid to rest, when the bereaved family began to hear the blood-curdling screams.

The Daily Buzz Live continues:

Police say when firefighters arrived, they received permission from the family to dig up the freshly dug grave. As they did, the screams became louder and louder.

When they reached the coffin, they pried it open, to find 34 year old Linda Lynch inside.

premAccording to a police spokesperson, it was one of the most twisted scenarios they’d ever encountered (and as you know a lot of weird things happen in ChiTown). What apparently happened this time around is alleged Funeral Director Lynch had ingeniously decided to murder his bothersome wife Linda and then pull the old switcheroo, substituting Linda’s corpse for the corpse of a “validly dead” client. The bereaved family would be none the wiser and Harold would to rid of the wretched woman forever. All that would remain would be disposing of the “validly dead” client quickly and surreptitiously.

So here’s what apparently happened. A brief but poignant funeral service was held for the “validly deceased” in the main hall at the Hite Funeral prem7Home, with Harold presiding. Then as the mourners headed for the graveyard to witness the closed coffin ceremony, Harold quickly wheeled the coffin back to the cool room, popped the “validly deceased” out of it and replaced him with Linda whom he had fed a walloping dose of arsenic and who appeared to be quite dead. Then he wrapped the validly dead client in a blanket and stashed him in a storage closet.

After that it was easy. Off to the old graveyard and into the ground. It all went off without a hitch except for one serious problem. Linda apparently had the constitution of Keith Richards and woke up 15 minutes after she was six feet under. Thus, it’s quite understandable that she started screaming like a banshee.

prem8Linda is reportedly in stable condition now at the hospital “undergoing an intense detoxification process.” According to some reports, it often takes several days for arsenic to leave the system and can take months in extreme cases. Considering that Linda reportedly ingested enough of the substance to pole-axe a steer, I imagine it will be awhile before she’s back on her mettle.

As for Harold Lynch, first-degree-murder is no joke. His big mistake was resorting to arsenic. Cyanide is far more effective and harder to detect. But he came close to pulling it off. It’s not something I recommend, however. It’s probably better to steel your nerves and start writing checks to a marriage counselor, or if all else fails, to your friendly divorce lawyer.

Getting Away with Murder: Serial Killers Who Were Never Caught

“Getting away with murder” now serves as a euphemism for avoiding the consequences of just about any kind of bad behavior. In its most literal sense, however, the phrase points to an especially troubling phenomenon — serial killings committed by psychopaths who somehow manage to avoid being caught and convicted of their crimes. The Zodiac Killer, who terrified the San Francisco Bay Area in the late 1960s and early 1970s with a string of murders accompanied by bizarre cryptograms and letters to the press, is probably the most famous murderer who was never captured. The Zodiac is not alone, however.  Our recent history is littered with unsolved mass murders. The following rogue’s gallery — presented in no particular order, since they are all equally hideous — lists some of the ones who got away with the worst crimes imaginable.

 

boneThe Bone Collector is an unidentified serial killer from the area known as the West Mesa of Albuquerque, New Mexico. In 2009, the chance discovery of a human bone by a dog-walker led police into something closer to an archaeological dig than a typical crime scene. The remains of eleven women, later determined to have been prostitutes, were slowly excavated from the area — which turned into the largest crime scene in U.S. history. Yet not a shred of promising evidence was ever unearthed from this macabre dumping ground — no DNA, no potential murder weapons, no personal clues, nothing at all. Sex workers in the area still live in fear of the killer, even though no murders associated with him have been reported for several years. To this day, the Bone Collector’s identity remains a complete mystery.

 

axeThe Axe Man of New Orleans was responsible for at least eight killings in New Orleans, Louisiana (and surrounding communities) from May 1918 to October 1919. Typically, the back door of a home was smashed, followed by an attack on one or more of the residents with either an axe or a straight razor. The crimes were not considered linked to robbery, since no items were removed from the victims’ homes. The Axe Man was never caught or identified, and his crime spree stopped as mysteriously as it had started. He wrote a notorious letter to address the public, which was printed in the newspapers. Beneath the heading, “Hell, March 13, 1919,” the Axe Man explained that he was a non-human spirit, something close to the “Angel of Death,” and he vowed to take more victims before he departed earth for his native “Tartarus.” He also made it clear that music was of crucial importance:

“I am very fond of jazz music, and I swear by all the devils in the nether regions that every person shall be spared in whose home a jazz band is in full swing at the time I have just mentioned. If everyone has a jazz band going, well, then, so much the better for you people. One thing is certain and that is that some of your people who do not jazz it on Tuesday night (if there be any) will get the axe.”

 

chopCharlie Chop-Off was active in Manhattan between 1972 and 1974. He killed five black children, and attacked another who he left for dead. The nickname comes from the genital mutilation inflicted on the male victims. A principal suspect, Erno Soto, was arrested and did end up confessing to one of the murders. But Soto was considered unfit for trial and sent to a mental institution instead. The case is still considered open.

 

darkThe Grim Sleeper of Southern California is thought to be responsible for at least ten murders, plus an additional attempted murder, in Los Angeles from 1985 to roughly 2007. His nickname derives from the fact that he appeared to take a Rip Van Winkle style nap, in the form of a 14-year hiatus from crime, during the years 1988-2002. When he was active, there was so much killing going on in L.A. at the time that it was hard to distinguish one murderer’s work from that of another. Thus, the Grim Sleeper was initially confused with the Southside Slayer. In any case, when the May 2007  murder of 25 year-old Janecia Peters was linked through DNA analysis to as many as twelve unsolved murders in L.A. dating back to 1985, a special task force was formed. The Grim Sleeper’s profile emerged as an African-American man who had sexual contact with his victims before strangling or shooting them with a .25 caliber handgun. On July 7, 2010, a suspect was arrested. Lonnie David Franklin Jr., 57, was charged with ten counts of murder, one count of attempted murder, and special circumstance allegations of multiple murders. We still don’t know if Franklin is guilty, though, although he apparently will be going to trial soon for what amounts to a quarter century of killing — with plenty of time off for sleep.

 

torsoThe Cleveland Torso Murderer (also known as the Mad Butcher of Kingsbury Run) was an unidentified serial killer who killed and dismembered at least 12 victims in the Cleveland, Ohio area in the 1930s. The Torso Murderer always beheaded and often dismembered his victims, sometimes also cutting the torso in half — in the style of the Black Dahlia corpse. Most of the male victims were castrated, and there was also evidence of chemical treatment being applied to their bodies. Although two suspects were investigated for these horrifying crimes, with Elliot Ness in charge of Cleveland police at the time, no one was ever convicted of the murders.

 

 

 

phan2Jack the Stripper was responsible for the London “nude murders” of 1964 and 1965 (also known as the “Hammersmith murders” or “Hammersmith nudes” case). The similarities with the nineteenth century Ripper murders are obvious. The Stripper murdered at least six prostitutes, whose nude bodies were discovered around London or found dumped into the River Thames. Two additional victims are often attributed to him, although these do not appear to fit his modus operandi. The Stripper’s third and seventh victims were allegedly connected to the 1963 Profumo Affair. Also, some victims were known to be involved in London’s underground party and pornographic movie scene. Scotland Yard’s initial investigation included nearly 7000 suspects, which was supposedly narrowed down to just 20 men, then 10, and eventually only three. No one was ever convicted of the crimes, and the Stripper, for whatever reason, ceased his killing spree.

 

phan3The Doodler was responsible for slaying 14 men and assaulting three others in San Francisco between January 1974 and September 1975. The nickname derived from the perpetrator’s habit of sketching his victims prior to having sex with them and then stabbing them to death. (One wonders whether the sketches ever made it onto the murderabilia market.) The perpetrator met his victims at after-hours gay clubs, bars and restaurants. Police zeroed in on a prime suspect in the case, who was identified by two of his surviving victims. Yet the cops were unable to proceed with an arrest, since the survivors (an entertainer, and a diplomat) refused to “out” themselves by way of testifying. The suspect, who never admitted his guilt, has never been publicly named, and the murders have faded into obscurity.

 

tobyBible John reportedly murdered three young women after meeting them at the Barrowland Ballroom in Glasgow, Scotland between 1968 and 1969. All three women were raped, strangled, and beaten to death. Just prior to the third murder, the killer supposedly took a taxi ride with the the victim and her sister. The sister said the man, who was named John, was soft-spoken and liked to quote from the Bible. As of 2013, the killer has never been identified, although the location and activities of known Glaswegian serial killer Peter Tobin strongly suggests that he may have been behind the killings. No proof of this has ever been established, however, and the case remains unsolved.

 

 

 

phanThe Phantom Killer is responsible for the “moonlight murders” committed in and around the twin cities of Texarkana, Texas and Texarkana, Arkansas in 1946. The Phantom Killer is credited with attacking eight people, and killing five of them. The attacks occurred on weekend nights, nearly always three weeks apart, and always involved a .32 caliber pistol. The case terrified the entire area, and eventually inspired the 1976 horror film, The Town That Dreaded Sundown. Two of the earliest victims were able to give a description of their attacker — and it only served to heighten the sense of terror. They described a six-foot tall man with a plain white sack worn as a hood over his head, with holes cut out for the eyes and mouth. One suspect, a man named Youell Swinney, was imprisoned as a repeat car theft offender in 1947, and released in 1973. He was never charged with the crimes. Due to the killer’s hooded disguise, some in law enforcement and the press have speculated that the murders may have been the early work of the Zodiac Killer, but this has never been proven.

 

kidsThe Babysitter Killer of Oakland County, Michigan was responsible for the murders of four or more children — at least two girls and two boys — in the years 1976-77. The children were abducted and then held for time periods ranging from 4-19 days, before they were killed by either strangling, suffocation, or shooting. Two of the victims were also sexually assaulted with an object. These atrocious deaths caused extreme public fear bordering on mass hysteria, and triggered a murder investigation which was the largest in U.S. history at the time. The Detroit News offered a $100,000 reward for the killer’s apprehension. A number of suspects were investigated — some authorities even considered John Wayne Gacy to be a likely perpetrator. However, the murders remain unsolved.

A more deranged bunch than this is difficult to imagine. How did they get away with it? Dumb luck? Skillful evasion? Police incompetence? Or all of the above? The truth probably resides in the simple fact that it is often just plain difficult — and very time-consuming – to solve murder cases. We tend to take homicide investigations for granted, and assume that justice will be served. However, given the sheer number of homicides, and the complexities involved in most cases, we shouldn’t be surprised that some of our worst psychopaths are able to slip through the cracks, and get away with murder.

Skylar Neese and the Mean Girls Who Killed Her

Skylar Neese was just 16 years old when she climbed out of her bedroom window for the last time on July 5, 2012 at around midnight.  She was a bright teen, with a strong work ethic in both school and her part time job at Wendy’s.  But she had a taste for the party life, as many teens in small towns do.  This wasn’t her first time sneaking out of her home late at night, as was evident by the stool she’d left outside beneath her bedroom window to facilitate getting back into her room undetected by her parents. Mom and Dad were none the wiser.

When her father came home from working the night shift to drop off his car for Sklyar, she was nowhere to be found. Her mother wasn’t too disturbed – after all, Skylar was 16 and it was summer; she could be out with her friends shopping or swimming.  Dad called around to some of Skylar’s friends to see if they’d seen her, but came up empty. When the manager at Wendy’s called to ask if Skylar was coming to work, red flags went up for mom, since Skylar never missed work. The police were then called in. Weirdly, however, law enforcement presumed Skylar to be one of the many kids that run away from home each summer in a quest for independence and adventure. The Neese’s were not convinced of that and as the summer wore on turning to autumn, they became increasingly certain that this was not a choice that Skylar had made for herself.

sky6They were comforted and aided in their search for their daughter by one of her best friends — Shelia Eddy.  They’d known Shelia for years and thought of her as another daughter. In September, when school started, Skylar still hadn’t surfaced. Her bank accounts, social media accounts and cell phone had not been touched. Now, the climate began to change. The Neese family had a Facebook page that Mary (Skylar’s Mom) had set up to help people exchange information and hopefully help in the search for her daughter. Shelia Eddy was one of the posters on that page, posting about how she missed Skylar and hoped she’d come home.  Sadly, in reality, Shelia already knew all too well that Skylar would never be returning to her mother’s embrace.

sky9What is fascinating about the quest to find Skylar is how it played out on social media, particularly on Twitter. You see, Skylar had two best pals — Shelia Eddy and Rachel Shoaf.  She’d known Shelia for many years while Rachel had only joined their little posse about a year or so before.  But of course, in high school, a year can be an eternity. But now it is September; all the kids except one are back in school and they are talking. And talking. And they do it on social media, unlike any generation before them. Many of the kids suspected Shelia and Rachel of doing something to Skylar, or at the very least, knowing something.  What was amazing was that many of the details of the actual events that some of these kids tweeted about turned out to be the truth. In October and November, Skylar’s body hadn’t yet been found but kids at the school were tweeting to Rachel and skyasking about the big cut on her leg that she’d had in the days just after Skylar’s disappearance.  They tweeted to Shelia but she was much more brazen and impervious to the harassment.  Much of this was done via ‘subtweets’, which don’t call out a particular person, but those who are close to the subjects are completely aware of the context. And then the sock puppet accounts showed up.  They were anonymous and were very blatant in their accusations. This was in December of 2012. The two suspect girls were called  “pretty little liars” based on the TV series about mean girls who murdered.

sky4It was in December that Rachel Shoaf cracked.  She’d had a blowout with her mother who decided that Rachel needed more help than she could provide and called police who hauled her off to a local mental hospital for several weeks.  I give credit to Rachel’s mother for having the courage to intervene like that.  It had to be hard for her but it turned out to be the thing that broke the case.

Rachel, apparently guilt-ridden, went to a lawyer after her stint in mental care and confessed all.  And I mean ALL. Her attorney worked out a deal with authorities and in January, Rachel led them to Skylar’s remains which had been concealed in a remote area of Pennsylvania since that fateful night she’d crawled out her bedroom window.

In the meantime, one could watch the breakdown of Rachel and Shelia’s trust on Twitter. Rachel had cooperated with police and FBI in order to get a plea deal and implicated Shelia in the process. Shelia was the ultimate mean girl.  Her hubris was evident from her demeanor on Twitter and she clearly thought that she was above punishment for killing her best friend. She even tweeted “Yes it’s true, we went on 3 – referring to the fact that Shelia and Rachel had planned the attack on Skylar and stabbed her to death on the count of three.

This year both girls were finally brought to justice, with Rachel getting 30 years for her plea to 2nd degree murder and Shelia getting 15 to life for her plea to Murder One.  The horrific details came out at Rachel’s sentencing when the prosecutor read from Rachel’s confession.  They had lured Skylar from her home sky8intending to kill her.  They had driven to a remote area in Pennsylvania, just over the border from West Virginia.  They got her behind the car and on the count of three they both stabbed her to death with kitchen knives.  They stood over Skylar until she stopped breathing and then concealed her body with leaves and brush. They cleaned up with the cleaning supplies that Rachel had brought along and changed their bloody clothing.  They then drove home and went to bed.  These were children. Teens. How do teens plan, perpetrate and conceal a crime such as this? Skylar was murdered in July, Rachel broke in late December and Shelia was arrested the following May. I believe that social media played a part in breaking Rachel and it certainly played a role in demonstrating how cold and callous two teenage girls could be.  Shelia and Skylar’s twitter accounts are still up, though Rachel locked hers during her breakdown.  It’s a forensic psychologist’s dream since you can watch the plot unravel over time.  No one really knows the why the “mean girls” ran amuck. Rachel’s confession states that they “just didn’t want to be friends with her anymore”. Can the motive for murder really be as mundane as that?

Brittany Murphy and the Terror Within

After the initial shock of Brittany Murphy’s death on December 20, 2009, several questions were raised about her premature passing. Her husband Simon Monjack was in disbelief and at a loss to explain why his 32-year old bride could have encountered such a tragic end.

simonMonjack was a strange bird with a shady reputation. Unlike Brittany, who had been and remained one of America’s sweethearts, this out of shape older Britt had not won the heart of many. He was a talented photographer and an unemployed screenwriter, but his career was in Slow Mo and he had left a trail of unpaid debts and child support. The word around town was that he was an opportunist using Brittany for the lifestyle, and that he was ruining her career opportunities with his constant meddling. She had recently been fired from a movie set because of him.

On the other hand, mother and daughter Murphy seemingly lived happily with Monjack in their opulent brittany's homehome on the hill in the city of Fallen Angels. Sharon Murphy who had a front row seat to their relationship, only had positive things to say about her son-in-law and she even continued living with him after losing her daughter.

Monjack often spoke to the media of someone who could be “out to get us” and even opened his home up to reporters after Murphy’s death, revealing an elaborate security set-up.

There’s actually 56 cameras that cover the house,” he said two months before his own death, as he showed off his high-tech security system.

Inside the house, outside the house, down into the cul-de-sac.”

Along with the 56 cameras, he also had biometric door entries and even a system that scrambles the phone lines if someone tries to record conversations.

Monjack said that both he and Murphy were in fear for their lives and they believed someone was watching them. He even believed that they were in danger of someone “slipping them something.’’

The fact that he died on May 23, 2010, five months following the death of his wife at age 40, and of the same thing, acute pneumonia and severe anemia, also raised questions. But considering that he had cardiovascular problems, was overweight and like Brittany, was consuming loads of prescription pills, it might not have been such a surprise after all.

moldThe LA County Department of Health examined the possibility of toxic mold having been found in the home as possible cause of death but it was later dismissed. After all, Brittany’s mother was living there and she was not showing any signs of intoxication. On the other hand, they found a huge range of over-the-counter and prescription medications in the two victim’s system.

Brittany Murphy was prescribed at least 200 pills monthly from 2008 through 2009, and it sometimes went up to 400. She was using an alias at the pharmacy for nearly two years before she was finally cut off 4 months before her death.

The records indicate that she was getting regular prescriptions of Hydrocodone, Clonazepam, Klonopin and Vicoprofen and certain months, the doses were doubled. The medications were prescribed by Dr. Richard Kroop who received a visit from the authorities during the investigation. He told the investigators that his pharmacy had cut off Brittany and her family 4 months before her death because, “We thought there was going to be an accident there.”

According to the autopsy, Brittany’s death was preventable. The primary causes were pneumonia, severe anemia and intoxication. The coroner believed her condition to be treatable, had she been taken to the hospital on time. The drugs pushed the outcome because of the pneumonia and anemia. So basically, she was sick and did not seek treatment so the anti-seizure medication, the acetaminophen and hydrocodone pushed her over the edge.

In spite of what her mother and widower tried to say at the time of her death, she had abused prescription drugs for years and it is a proven fact that opiate users often end up with anemia, heart disease, diabetes, pneumonia or hepatitis. In light of these facts, it is hard to comprehend why the coroner came up with such a simplistic conclusion as death of ‘natural causes’at the time, even if she had developed some health problems brought upon by the use of prescription drugs.

Ibritt emaciated was also quite surprised that the coroner’s office found no evidence she was abusing drugs. You only have to look at photos of Brittany and her husband during that period and consider what she was prescribed through the years to conclude that they were addicted to something. Brittany was emaciated and looking unwell. Her husband was bloated and not the picture of health either, but it was not as obvious as his bride. But I guess they chose to buckle the case with a pretty bow on top, and used the toxicology reports without trying to tie them to other logical possibilities.

It looked very similar to the Anna Nicole Smith case who also died because of her addiction to prescription pills.

Since her death, Brittany’s biological father, Angelo Bertolotti, has crawled from under his angelorock and petitioned the court to obtain hair, blood and tissue samples of his dead daughter to be analyzed for the presence of poisons in her system. He sent the strands of hair to a private lab and the results came up indicating the presence of 10 heavy metals as evidence of a poisoning death.

He is now writing a book called Britt with Julia Davis to explain his conspiracy theory. The documentary The Terror Within came out in 2012 and might now be reloaded.

CNN obtained the report by forensic toxicologist Ernest Lykissa, who concluded that the hair from the back of Murphy’s head had higher than recommended levels of 10 heavy metals. “If we were to eliminate the possibility of a simultaneous accidental heavy metals exposure to the sample donor then the only logical explanation would be an exposure to these metals (toxins) administered by a third party perpetrator with likely criminal intent.”

ernest lykissaLykissa, who operates a toxicology testing lab in Deer Park, Texas, did not respond to several calls from CNN to discuss his findings.

The director of forensic medicine at the University of Florida, who is the president of the American Board of Forensic Toxicology, reviewed the report and was very critical of its content. ”It’s ridiculous,” Dr. Bruce Goldberger said. A conclusion of poisoning is an “inflammatory statement” that “is a baseless allegation and outrageous statement to make based on a single hair test.”

Her autopsy indicated no physical signs of poisoning, he said. “A hair test alone, without any clinical signs or symptoms, cannot be used to establish poisoning.” The private report also showed a normal level of arsenic, which would have been elevated if rat poisoning was involved, he said.

She was a beautiful woman and likely had numerous hair treatments,” Goldberger said. “Chemicals in the hair treatment would alter the chemistry of the hair sample.’’

A hair sample can be affected by many factors such as hair dye, hair spray, prescription medications, foods, smoking even if occasionally and even the environment. So it would take way more than these private lab results to draw serious conclusions on the matter.

Sharon Murphy was infuriated by Bertolotti’s statements. She said ‘’I have no choice now but to come forward in the face of inexcusable efforts to smearsharon murphy my daughter’s memory by a man who might be her biological father but was never a real father to her in her lifetime.’’

She went on to say ‘’Angelo’s claims are based on the most flimsy of evidence and are more of an insult than an insight into what really happened.’’

Brittany’s mom thinks that Bertolotti is trying to profit off of his daughter’s tragedy with the publicity surrounding the poisoning ‘revelations’. She is convinced that a toxic mold found in the house may have killed her daughter and son-in-law even if the Los Angeles County Assistant Chief Coroner said there were no indications of mold in the house at the time.

Sharon disagrees and had filed a lawsuit stating that she discovered extensive water damage and mold infestation in the house where her daughter and, later, her son-in-law died suddenly; the Nina Bow Trust, which owned and operated the property, sued the contractor, subcontractor, and others back in 2006 over all of the perceived construction defects.

Britt and the Terror Within

angelo bertolottiAngelo Betolotti’s book and documentary explain how his daughter and Simon Monjack’s death are linked to Brittany’s support for government whistleblower Julia Davis.

In an interview he gave to the Fleur de Lis Film Studios in LA, Bertolotti said: ‘They were, in fact, under surveillance, including helicopters. Their telephones were wiretapped, Brittany was afraid to go home, because of the sneak-and-peek incursions into their residence and other terror tactics she suffered after speaking out in support of Julia Davis and being named as a witness in her lawsuit against the Department of Homeland Security.’

Julia Davis claimed that while working at the US border with Mexico she uncovered evidence that dozens of potential terrorists had entered America in shady circumstances that may have involved the bribery of customs officials.

She has a whistleblower website where she wrote that family members and witnesses who supported her were ‘subjected to land and aerial surveillance, to the tune of millions – at the expense of American taxpayers.’

This included warrantless aerial surveillance with fixed-wing airplanes and Blackhawk helicopters, vehicular surveillance, OnStar tracking, Internet black hawksmonitoring, wiretaps, warrantless searches and seizures and series of other outrageous, unwarranted retaliatory measures.’

On the National Whistleblower Center website, Julia Davis said she ‘prevailed’ in court against the Department of Homeland Security despite a total of 54 ‘retaliatory’ investigations being launched against her in an ‘attempt to discredit Julia as an upstanding law enforcement officer and a staunch American patriot.’

The site also has photos of Angelo Bertolotti with his daughter and visiting her grave. He also says that Brittany ”was called as a witness in the Julia Davis case.” He added: ”Brittany did tell me she was under surveillance and incidentally so was I.”

harvey LA coronerCraig Harvey, the chief of operations for the coroner declared ‘’we stand by our conclusions and opinion.’’ ‘’We have no plans to reopen the inquiries into the deaths of Miss Murphy or Mr. Monjack.

Like so many others, I really enjoyed Brittany’s screen presence and persona. She had a unique quality with big meaningful eyes that could tell a whole story without words and a smile to light up the planet. The sadness of her passing is compounded by the ridiculous claims floating around since she left. I get the impression that this tender soul was surrounded by bloodsuckers in life and now in death. The terror is and often remains within, and in her case, her own husband and some members of her family seemed to have used her as a cash cow without much care for her mental or physical health.

Two’s Company, Three’s a Deadly Crowd: The Cruel Killing of Martha Gail Fulton

Donna Kay Tapani paid three misfits to murder Martha Gail Fulton, the wife of her former lover, George Fulton. That’s the simplest story; the motivations and complexities of this case run much deeper than what’s readily apparent on the surface.

Gail Garza was a devout Catholic girl who grew up in small town Texas. She met George and they dated but she still maintained her college aspirations and completed a degree in speech pathology. In the meantime, George went off to West Point and a career in the Army. He reunited with Gail and they soon married, anticipating a typical peripatetic military existence.

adon9Gail soon had three children, born at different duty stations, including locations in Germany and the US. She was a devoted and doting mother and wife, believing it to be her destiny as sanctioned by her faith. George, however, if rumors are to be believed, had a wandering eye that was followed by other body parts. One documented dalliance occurred when the couple was stationed in Panama which led Gail to return home abruptly to her home town in Texas. During this period, Gail reportedly became very depressed and lost so much weight that her family was concerned she was anorexic. Gail had severe self-esteem issues and her weight loss was always an indicator of unhappiness. Perhaps she thought that exercise and slimness (about which she was obsessive) would make her more attractive to her husband, or more likely, this was her obsessive reaction to the pain she couldn’t seem able to stop.

adon5George eventually retired from the Army and Gail assumed that they would lay down roots amongst her family in Texas, as they had always planned. That was not to be; George, flailing about to find a career after military service, decided unilaterally to move the family to Lake Orion, Michigan, a small community outside of Detroit. Reluctantly, Gail, as always, gave in to her husband’s wishes.

adon2Gail settled into life in that community with her husband and two of her three children. The move was so abrupt that her oldest child opted to remain in Texas with Gail’s mother while she pursued a college degree. Gail’s two younger children — Emily and Andrew, still in high school, made the big trek to Michigan with their parents. It’s fairly clear from Gail’s friends and family back in Texas, and her children, that she was not very happy during that time. Gail always seemed to lose weight and become anxious and stressed when her life presented difficulties, and during this interval she was rail thin and looked old beyond her years. Mostly she dealt with adversity through talking with her priest, praying and doing her nightly rosary beads, convinced that God would see her through the difficult times. Sadly, her life in Michigan would have more challenges than joys and Gail wasn’t always up to the task.

Screen Shot 2014-08-07 at 4.05.14 PMThe job that precipitated George moving his family to Michigan dissolved in a matter of months, and once again, he began seeking the brass ring. He thought he found it in an opportunity in Florida, working with a company called Concerned Care Home Health (CCHH). In truth, however, it was the beginning of disaster. While in Florida on business, George had a chance encounter with a vivacious, outspoken woman, quite the opposite of his wife Gail, named Donna Kay Trapini. She seemed smart, articulate, driven and extremely interested in sex, which presumably after 21 years of marriage, he felt that his wife could or would not provide. He embarked upon a passionate physical affair that was to last nearly two years before his long suffering spouse discovered their relationship.

Gail kept the home fires burning while her husband traveled and worked to keep food on the family table. While she was intelligent and well educated, Gail was guided by her abiding Catholic faith and believed that her place was with her children and her family. However much she tried to maintain her steadfastness through faith, the chinks in her armor showed through, however. Gail often talked of suicide when her husband was away and in her heart, she adon10knew he was unfaithful. She shared these suicidal feelings with her teenage children who lived at home, and as a result, they were constantly in fear for her safety. With their father always gone on business and their mother expressing suicidal ideations, the children had an unsteady and frightening introduction to young adulthood. All these feelings started to come to a head in the late spring of 1999, when George’s mistress and, by this point, boss, began to extend their relationship beyond their adulterous bed and into his family home.

George somehow thought that he could have whatever he wanted, whenever he wanted it. He actually left his wife, Gail, to move in with his mistress Donna Trapani in Florida in early 1999. He never told Gail, however, that he was moving out; rather, he simply told her that he needed an apartment in Florida to pursue his fledgling business. Somehow Gail bought into this. So George moved in with Donna and soon got to know his mistress, perhaps more than he wanted to. Donna turned out to be a woman of many faces.

Donna Kay Trapani was born in mean circumstances in Louisiana to a mother who hadn’t education or wealth, and a father who’d skipped out before she set foot into the world. Donna struggled with her weight throughout her years in school and finally had bariatric surgery in her early college years. Her ensuing weight loss boosted her self-confidence and she went on to participate in collegiate pep squads as well as the active dating life she had always desired but had been denied in her early years. Even Screen Shot 2014-08-07 at 3.13.00 PMDonna’s mother, who to this day believes in her innocence, admits that Donna was obsessed with her appearance and success both before and after her surgery. Narcissism is typically self-loathing and insecurity masquerading as bravado. Donna met and married her husband, an aircraft mechanic, and moved to the Florida panhandle. There are reports that Donna and her husband were unable to conceive a child; perhaps that’s true, I cannot say. However, Donna had ambitions for herself and wasn’t content to simply be the wife of a mechanic. Nursing degree in hand, she started an employment agency for visiting nurses and was determined to become a business tycoon. Reports from many of her previous employees indicate that Donna was volatile with a vile temper, and often lashed out at people over the smallest of infractions. They also indicated that she was a habitual liar, something she demonstrated herself when she took the stand in her own defense at trial. Her stories were wildly improbable, but she would cling to them as though by simply telling them, she could make them true or even believable.

When she met George, Donna was CEO of her company CCHH, and was often out on the town at the bars with the single nurses from her firm, despite having a husband at home who disapproved of this behavior. We get the sense that Donna did whatever Donna wanted; she was always in charge and always needed to be the commander. At any rate, she and George inevitably struck up a physical relationship which grew from there to take on epic proportions, which would ultimately cost Gail her life.

Screen Shot 2014-08-07 at 3.13.58 PMDonna was pretty clear about her intentions throughout the affair. She wanted what she wanted, and she wanted it on her terms. She wanted George, sans wife, and she would do whatever it took to get there, including murder. George, on the other hand, did what he had done his whole life; he manipulated, cajoled, lied and did the expedient thing to get what he wanted in the moment. George wanted hot sex on the side and a reverent obedient wife at home. So he told Donna what he believed she wanted to hear and didn’t tell Gail much of anything. Gail wanted what she wanted too, but she prayed to God to give it to her instead of facing her issues and addressing them with her husband. She did resort to threats of suicide and tried to inflict guilt on George in the hope he would change. Clearly, her efforts could not succeed and the situation grew increasingly volatile.

There have been untold numbers of love triangles, with unfaithful husbands, leading to divorces and families shattered by the sins of the flesh, but this triangle was a mix of personalities that seemed doomed to end in tragedy. A prime example of how these three dysfunctional personalities interacted is their behavior over the 4th of July weekend in 1999. What all three of them did adon12is nearly incomprehensible to most people involved in normal relationships. Donna, having been thrown over by George some months earlier, sent him a letter on doctor’s letterhead, stating that not only was she pregnant but that she had terminal lymphoma as well. George, being either completely gullible or wanting to have his cake and eat it too, invited Donna up to Michigan for the holiday weekend so that she could search for an apartment near his home. He said his goal was to be able to take care of Donna and the anticipated child in her time of need. To facilitate this misguided plan, George set up a meeting between his wife and his mistress at Donna’s hotel. This, of course, was a total failure. Gail became hysterically distraught and Donna turned cruel and vicious, and became even more possessive. George decided to spend the night with Donna in her hotel room, had sex with her, and then dumped her the following morning. The fact that Gail let him back into the family home after this is an indication of her complete lack of self-esteem and total dependence upon George. This disastrous weekend turned out to be the trigger that would set the murder in motion.

adonDonna Trapani was infuriated over being dumped and became obsessive about winning George back. She began a torrent of phone calls to his home, letters, emails and faxes in which she first tried cajoling and wheedling, then laid on the guilt trip, and finally resorted to vitriol in order to make George come back. Much of the venom was directed at Gail, whom Donna viewed as the barrier to their relationship. When all her attempts failed, as they were destined to do simply based on the hysteria of the communications, she hired three misfits to take out her rival in a hail of bullets. She enlisted one of her habitually errant employees — 38 year old Sybil Padgett, and Sybil’s 19 year old boyfriend, Patrick Alexander, to plan and carry out the murder. They, in turn, connected Donna to Kevin Ouellette, the intended trigger man, a cold opportunist who would do anything for a fast buck. Promised $15,000 from Donna, the hit squad headed to Lake Orion from their Florida home to execute Gail Fulton. Donna’s big mistake was not realizing that if you hire killers, you probably need to actually pay them. Since she failed to follow through on her part of the bargain, all three of her co-conspirators rolled over on her and she was eventually arrested for first degree murder and conspiracy to commit murder. Kevin and Patrick were offered plea deals in return for their testimony against Donna and Sybil, but the prosecutors had no intention of offering any such deal to the women, both of whom were convicted and sentenced to life in prison without parole. Both subsequently lost their appeals.

adon4I believe Donna suffers from Borderline personality disorder with marked narcissistic features. When you analyze her actions with her employees, her ex-husband, her ‘recruits’ for murder, and her behavior afterwards, it’s clear that she is disorganized in thought and deed. She is prone to dramatic mood shifts, outbursts of anger and delusional thought patterns. Her constant self-aggrandizing precludes all feelings of conscience for her actions. She truly feels that any means justify the ends, which in her case are whatever she happens to desire at the moment. In this, she reminds me of Jodi Arias. Both believe that they deserve the object of their desire. Both believe that this “object” will propel their lives beyond the mundane existence they believe they currently have and fantasize that a life with this person will enhance their lives far beyond their current state. Both were devastated when the object of their desire rejected them, and they acted out in the only way they apparently could – with fury and destruction. Both told wild tales about their actions with seemingly no compunction, both on and off the witness stand, and both gave TV interviews over their attorneys’ objections immediately after their convictions. Sadly, both were destined to lose their ‘prizes’ because their intrinsically flawed psyches would ultimately preclude them from any type of successful relationship that would fulfill their needs. It’s a tragedy that people fell victim to them, but it was perhaps inevitable given their manipulative, determined natures.

adon8What made Gail Fulton’s murder even more tragic was her complete innocence and probable naivete. While her death was no one’s fault but Donna and her cohorts, Gail contributed to the situation by not standing up for herself or insisting that George behave in a manner appropriate for a husband and father. By allowing George to mistreat her, disrespect their marriage, and return home forgiven, despite his lack of remorse or apology, she gave him free rein to do as he pleased. George must have thought that he had the perfect situation. His wife would never leave him nor kick him to the curb. He could fulfill his sexual desires and still maintain the semblance of a stable home and family life. George essentially loaded the gun that was Donna Trapani. Did he know that she had severe issues that could turn deadly? It’s not likely that he did, but his willful ignorance when her behavior became obsessive and erratic placed his family in grave danger. The toxic mess resulting from these three personality types being thrown together and placed under extreme duress inevitably exploded killing Gail Fulton and destroying lives and families in both Florida and Michigan.

My Tulsa neighborhood near 1st Street and 168th East Avenue is reeling in shock today. Yesterday was an ordinary day in the neighborhood until a very strange thing happened. I was changing my 1-year-old’s diaper when my 3-year-old came in carrying a handgun. It was a fine gun, my husband served in the military and he knew his firearms. Somehow my little guy found it and I was about to tell him to put it down immediately when he shot me through the head.

christa2When you die, it doesn’t happen all at once. You kind of hang around for a while, and though I couldn’t see things that clearly, I could see enough to know that everyone was very upset. A homicide detective with the Tulsa police named Dave was beside himself and kept saying:

“It was a horrible, horrible accident.”

christa4But what was breaking my heart was the fact my little guy knew he had made a big mistake. He just wasn’t sure yet how big a mistake. When the police came, they realized he was the only possible suspect, since I didn’t shoot myself in the head. So I had to watch from the other side as they loaded my little guy into a police patrol car and drove him off to be interviewed by child specialists who will try to get him to describe what happened. Actually, he was saying all that needs to be said as they were taking him away. “Mommy shot! Mommy shot!” he kept saying over and over again

My mother-in-law, who lived with us, found me bleeding when she came home yesterday at 4:30. She called an ambulance and I was taken to the hospital but it was too late.

christa7My husband was working when my son shot me. I don’t think he knew what had happened until he got home about 8:00 o’clock and heard the awful news. I know that he’ll never be the same and I don’t think my son will either. And of course we know that I’ll never be the same.

What was most heartbreaking was how scared my son was. He tried his best to scram when his grandmother got home but he didn’t get away in time. But I like to think that much as he wanted to leave, he also wanted to stay there with me.

christa6I heard the police talking and they were trying to figure out how my son got his hands on the gun. They said our house looked pretty kid-proof and they’re right – it is — except for the gun which was in an open holster lying on a coffee table in the living room.

I don’t understand why this had to happen. I just don’t. What cruel fate devised this terrible end to my life and this life sentence of anguish for my son and husband? Maybe where I’m going somebody – if there are any somebodies – will be able to explain it to me.

Good-bye, dear family. I wish I could help you but I can’t. And I don’t picture myself a ghost hanging around making everyone nervous. So this is Christa Engles signing off.

How to Raise a Serial Killer in 10 Easy Steps

You’ve decided you want the fame of being a serial killer but don’t want to commit the awful crimes. No problem, you can still raise your very own serial killer. It takes dedication and commitment but with this handy guide, you can be the proud mother of a notorious serial killer. Since murderabilia seems to be so popular, you may even make a few bucks on the side.

I’ve addressed this guide to the moms because they seem to figure prominently in the serial killer’s psyche, though you will have to be careful not to become his first victim. You will need to raise a male child, which will lead to the highest probability that you will succeed in creating a little monster.

how21.  Step one is to select the killer’s father. You will need to do this carefully. Choose an abusive alcoholic that will assist you in abusing the child when he is a toddler and then disappear into obscurity once the child has been sufficiently marred. You may have to endure considerable abuse in the presence of the child for the first couple of years. This will imprint the child with images of a dominant male and a woman who is unable to protect him. He will fear men and loathe women while at the same time craving their attention.  **Note, you do not need to physically bear the child; adopting him from a close relative and keeping it on the down-low is equally effective.

how112.  Dress the young boy as a girl and send him out amongst his peers. You could give him a girl’s name too, but then he might just turn into a country singer, and that’s definitely not part of the plan. Be sure to sneer and berate him as he parades around in dresses. This will confuse his gender identity which will lead to sexual confusion later in adolescence and young adulthood.

3. Try to drop the boy on his head frequently as an infant and toddler, or try to inflict head injuries through the frequent beatings you will administer without warning for minor infractions, such as spilling is cereal at breakfast. Do not get medical care for head injuries; they will heal on their own and the trauma can contribute to lesions and neurological disorders.

how44.  Be careless about his toilet training; alternate harsh discipline with periods of inattention. This will confuse the boy and foster bed wetting. Allow him to sleep in his wet bed for several days at a time before loudly condemning the child as a failure for not catching on to toilet training. Invite other youths in his neighborhood to the house during these episodes to ensure he will have an extremely limited social circle and few healthy interactions.

5.  Create an atmosphere of promiscuity and disposability in human relationships. You will need to frequently invite unsavory men into your bed and engage in loud, animalistic sexual behavior in front of the child. Preferably, keep the toddler’s bed in your own room while this is occurring. Children often equate the sounds associated with sexuality to violence, which will serve him well later on. You will also cultivate his voyeuristic side, a key component in a serial killer.

how86.  Send the child for extended visits to elderly relatives who have very strict, Calvinistic tendencies which will contrast markedly with the chaos in your own home. The boy will come to see religious practices and the accompanying rigidity as punishment. The contrast to his own abnormally chaotic home will make his usual existence seem quite normal to him, thus warping his sense of what is acceptable to society in general.

7.  Drugs and alcohol need to play a large part in the child’s upbringing. However, you need to appear functional to those outside the home so that others will not interfere and remove the child from the home before you’ve completed your mission. Leave alcohol and marijuana within easy reach of the child. He will move on to other substances on his own.

8.  Befriend a seemingly kind male who is a known child molester and invite him frequently to your home to babysit the child. The child will cling to this one kind anchor in his pathetic life and be lulled into participating in unnatural sexual practices. He will likely never report it. The abuse will confuse his sexuality even further, wracking him with guilt and hatred for both the molester and foryou for allowing it to occur, even encouraging it.

how9.  Collect or allow the child to collect a variety of stray animals. Be sure to abuse them within the home. Do not feed them and never clean their cages. Act as though their life is worthless. If the boy gets attached to an animal, be sure that it is removed from him by force and cruelly destroyed. However, by this point, it is doubtful that you will have to resort to barbarism yourself as the child will enjoy having a sentient being upon which to vent his anger and lack of self-esteem. He will embark on that long heralded hallmark of sociopathy — animal abuse. Never comment upon the abused animal corpses you may find around the home — let it be his secret as that will engender his mounting sense of power and control.

how910.  Cultivate a fascination with fire. Again, this is an area that will likely develop on its own if the previous steps are adhered to correctly. But you can encourage this by leaving lighters, matches and accelerants lying haphazardly around the domicile. Accidentally set kitchen towels alight in the boy’s presence to pique his interest and fascination with pyromania. Pyromania can be considered powerful as well as destructive and the youth will learn to lust for both.

how6If you’ve adhered to all these suggestions faithfully, you are well on the way to harboring the next great serial killer. Success is not guaranteed, though; serial killers are an elusive and rare breed and children can be remarkably resilient. But consistent chaos, belittling and social isolation will certainly make your chances of succeeding far greater. And as a side note, keep any drawings or art projects the child may create along the way, taking great care not to let him think you cherish them, as that could destroy all of your hard work. Instead, save them for after his arrest or death, since murderabilia has become a growth industry and you should reap some rewards for your efforts, in addition to the self-satisfaction you will attain from seeing your child achieve your dreams.

Ten Wickedest Female Serial Killers Past and Present

We found the following list of the  Ten Wickedest Female Serial Killers Than and Now at Nabanita Dhar’s website. It is noted that Dhar’s original post is titled: Top 10 Most Evil Women in History.  All Things Crime Blog has altered the text significantly but kept close to the spirit of Dhar’s text. And, of course, this list is hardly definitive. There are lots of other female serial killers who could join this “august company”.

 

10: Charlene Adelle Gallego 

charrGallego and her partner Gerald Armond wreaked havoc in Sacramento, California between 1978 and 1980. They kept a harem as sex slaves whom they utilized to spice up their own sex life. They ultimately killed around 10 of their victims. Gallego was apprehended in November 1980 and received a “sweetheart deal” not unlike Karla Homolka’s in return for testifying against her partner. She was not charged in California but pleaded guilty to murders in Nevada and received a sentence of 16 years and 8 months.

 

9: Ilse Koch

charr2This fiend from hell was the wife of Karl-Otto Koch, commandant of the Nazi concentration camps Buchenwald and Majdanek. Known as the “the concentration camp murderess“, she tortured and killed prisoners without empathy. This hag was an extreme sadist and kept the skin of murdered inmates with distinctive tattoos as souvenirs. The poor people around her called her “The Witch of Buchenwald”and “The Beast of Buchenwald”among other things.

 

8: Beverly Allitt 

charr3You gotta look out for those nurses, especially when they work in the Children’s Ward. This English serial killer was convicted of murdering 4 children and charged with attempting to murder 3 others. And she caused grievous bodily harm to half a dozen others. She worked fast too; all of her heinous crimes were committed within a 3-month stretch in the spring of 1991 in the children’s ward at Grantham and Kesteven Hospital, Lincolnshire. Unsurprisingly, the authorities described her as a “serious danger to society”. She was repaid for her crimes with 13 life sentences.

 

 

7: Belle Gunness

charr4This Norwegian-American female serial killer was tough as nails. Belle Gunness murdered her suitors, boyfriends, two daughters, and probably both her husbands as well as the rest of her children. She is believed to have killed around 25 to 40 people in all over the course of several decades. The true American Bluebird, she would split open the head of her victims with a meat chopper or simply chloroform them while they were sleeping.

 

6: Myra Hindley 

charr5Myra and her twisted partner Ian Brady were responsible for the Moors Murders between July 1963 and October 1965 in and around present day Greater Manchester, England. Their child victims were between 10 and 17 years of age, and at least four of them were sexually assaulted. She has been labeled “the most evil woman in Britain” by the press. She appealed her life sentence repeatedly with no success. She died in prison at age 60 in the year 2002. Her partner Ian Brady is still alive and has stated many times that he wants to die so that his misery can cease. Brady is usually on a hunger strike and is fed by means of a feeding tube. Oddly, at one point, Ian Brady in an attempt to minimize their horrific actions stated that the rapes and murders were merely “an existentialist experiment”.

 

5: Irma Grese

charr6Why can fathom the mind of a truly wicked woman? Of engaging appearance, this unsettling young Nazi was nicknamed the Beast of Belsen or the Hyena of Auschwitz. She “found a job” at the Nazi concentration camps of Ravensbrück and Auschwitz and was the warden of the women’s section of Bergen-Belsen. She was promoted to Senior Supervisor by the end of 1943, and was placed in charge of around 30,000 Jewish female prisoners whom she tortured and often murdered in cold blood. She was captured by the British in 1945 and executed for crimes against humanity at the age of 22. So much evil and so very young?

 

4: Queen Mary I

charr7This fiendish monarch is known for the brutal persecution of Protestants. During her reign, over 280 religious rebels were burned at the stake which earned her  distinctive nickname, Bloody Mary. She was the only child to survive the ill-fated marriage of Henry VIII and his first wife Catherine of Aragon. Queen Mary ruled as the Queen of England and Ireland from July 1553 until her death. She was the fourth monarch of the Tudor dynasty and is remembered for her restoration of Roman Catholicism for a brief period until her death. She is also immortalized in a line from a popular American 2oth century musical, “Bloody Mary is the one I love.”

 

 

3: Rosemary West

charr8The Brits seem to be placing extremely high in the female serial killer sweepstakes. Convicted in 1995 of 10 murders, which she committed along with her husband, Rosemary West was a British serial killer who is now imprisoned in Durham. The murders occurred between April 1973 and August 1979. It was the disappearance of Heather West, their daughter, that led to a thorough investigation of the couple and their subsequent conviction. Heather’s body was found at 25 Cromwell Street along with other bodies.

 

2: Elizabeth Báthory

charr9A undoubtedly striking and sophisticated woman, Elizabeth Báthory was a Countess from the renowned Báthory family in the Kingdom of Hungary and appears to have shared the oft-noted aristocratic thirst for blood. Known  as the “Blood Countess”, she is one of the most discussed female serial killers in history. She along with four of her partners have been accused of committing over 650 murders. Torture was also an integral part of their ritual. Though she was never tried or convicted, she remained confined in a set of rooms in Čachtice Castle upon her arrest in 1610 until her death.

 

 

 

1: Mary Ann Cotton

charr10This sly fiend murdered up to 21 children by poisoning them with arsenic. She first married William Mowbray. Four out of their five children died from gastric fever and then Mowbray succumbed to an intestinal disorder. Oddly enough, her second husband died of a similar ailment. But she didn’t stop there and racked up several more “life partners” who all died of intestinal disorders. The downfall of one of history’s most evil women came shortly after the death of her last husband, Charles Edward Cotton.  She was hanged by the neck until dead in 1873.

Watching Karla Homolka: A U.S. Perspective on Karla Homolka’s Plea Bargain

The case of Karla Homolka and her husband Paul Bernardo is one of the most spectacular criminal cases in recent memory. The case outraged many Canadians, particularly the fact that Karla received only a 12-year-sentence based on her serving as the Crown’s star witness at Bernardo’s trial.  Furthermore, in recent years, the theory that it was actually Karla who committed the murders of two Canadian teens has been presented and vigorously supported by a sizable number of individuals who have studied this case closely.

karl6In this post, I will wade cautiously into the treacherous waters of the Karla Homolka debate and offer certain observations about the case based, in part, on my discussions with Michael D. Sellers, writer/producer of the film Karla, and further reading suggested by him, and partly on my own experience working as a private investigator for many of Southern California’s finest criminal defense attorneys during the past decade. During this time, I have worked on over 200 state and Federal criminal cases, reviewed and commented on hundreds of plea agreements, and witnessed dozens of defendants receive either lenient or very lenient sentences in Federal court.

In addition, it must be stated that some of these favorable outcomes were achieved by combining the mitigating factors with the fact that the clients cooperated wholeheartedly with law enforcement and, in many instances, testified against co-defendants at trial.  Strong factors in mitigation combined with effective cooperation can eliminate years, and even sometimes decades, from what would otherwise be very lengthy sentences.

 

 A Brief Review of the Case

sisterPaul Bernardo operated independently, as the “Scarborough Rapist,” carrying out as many as 25 rapes, and was also the apparent leader in his and Karla’s criminal activities. Together, they were responsible for the rape and murder of two teen victims, Leslie Mahaffy and Kristen French, and the rape and accidental death of Homolka’s younger sister Tammy. Opinions vary dramatically with respect to who did the actual murdering.  Was it Paul, as the Crown successfully argued in its case, who murdered the girls? Was it Paul and Karla working together? Or, as some claim, was it Karla alone who did the killing? Although this question may never be definitively answered, common sense suggests that it was a team effort.  After all, the video evidence clearly demonstrates that Paul and Karla were both involved in Tammy’s death, Karla giving her the knockout drops, while Paul raped her both vaginally and anally. In addition, at Paul’s behest, Karla also sexually assaulted her younger sister. In the deaths of the two teen victims, the video evidence shows that both Karla and Paul were there together at their house while they held the two courageous girls captive.  Thus, from a legal standpoint, it makes little karl8difference which one “pulled the trigger.” Paul and Karla, to a large degree, acted in unison and they are both responsible for the outcome.  A good analogy would be a bank robbery in which two perpetrators go into the bank to execute the robbery while the getaway driver waits outside. If something goes awry and the robbers panic and shoot and kill two tellers, the getaway driver is also held responsible for the two homicides, which would probably be charged as 2nd Degree Murders, even though neither he nor the other two robbers initially intended for anyone to be hurt, much less killed.  If Karla Homolka and Paul Bernardo had been bound over for trial here in the United States, and if neither had received major credit for cooperation, they would both likely have been charged with Conspiracy to Commit 1st Degree Murder. The one who did the actual murdering, assuming they didn’t gang up on the victim and commit the deed in unison, would be charged with 1st Degree Murder. The other partner would be charged with aiding and abetting 1st Degree Murder or some variation thereof. The fact that both girls were tortured to varying degrees prior to the slayings would likely trigger the “torture enhancement” and if Paul and Karla were both convicted of these charges in California, they would almost certainly get the death penalty.

 

Karla Homolka’s Plea Agreement

Many individuals, both in Canada and in the United States, feel strongly that Karla Homolka’s Plea Agreement, which called for her to serve 12 years in prison based on a reduced charge of Manslaughter was much too lenient.  From a technical standpoint, Manslaughter is the appropriate charge when the defendant’s conduct does not meet the criteria of 1st or 2nd Degree Murder.  To be guilty of 1st Degree Murder, the deed must have been premeditated and committed with malice aforethought (malicious intent).  2nd Degree Murder occurs when premeditation is lacking but malicious intent is present.  Thus, if someone goes berserk and pulls out a gun and shoots someone, that person would typically be guilty of 2nd Degree Murder.  Manslaughter is readily distinguishable from Murder I and Murder II.  The key difference is that Manslaughter requires “intent to harm the victim,” not “intent to kill the victim.”
Paul Bernardo and Karla HomolkaBased on the trial evidence, it seems clear that Karla played a major part in doing in Leslie Mahaffy and Kristen French.  She clearly intended to harm them, but according to her testimony, she did not intend from the outset to kill them.  In the case of Leslie Mahaffey, when Bernardo said, “I’ve got to kill her,” because Leslie’s mask had fallen off and she could now identify them, Karla’s response was: “Well, give her some pills or something so she doesn’t feel anything.” Then, when Paul got the pills and gave them to Leslie prior to strangling her, Karla stood by and did nothing.  In the Kristen French case, Karla helped Paul capture their victim. Later, when it appeared Paul was going to finish the job on poor Kristen, Karla went and took a shower.

Based on these facts, the outrage over Karla’s plea deal on the part of the Canadian public is completely understandable.  Karla’s actions were utterly horrific and are made all the worse by the fact the victims were young and incredibly vulnerable.

karl2So the question becomes, based on this level of evidence against Karla, was the 12 year sentence reasonable? The natural and justified revulsion on the part of the citizenry toward Karla still needs to be set off against the fact that she cooperated and testified at trial, as well as the fact that she was severely abused on an ongoing basis by Bernardo.  My sense is that upon weighing all the factors, the 12 year sentence would probably be viewed as more or less reasonable by many legal professionals here in the United States.  It should be noted, however, that in a court of law, there is seldom such a thing as a completely fair sentence.  The results are always open to interpretation and, as we all know, reasonable minds can differ.

And, off course, there is the further issue that the Crown absolutely needed Karla in order to successfully prosecute Bernardo.  Without her testimony, their case against Bernardo might never have been brought to trial.

It’s important to recognize that time-honored phrases such as “the wheels of justice,” the “justice system,” and the “legal system” may convey a false sense of how the system actually works.  The phrase, “wheels of justice” suggests that the system is karl12machine-like in its scope and breadth, that it grinds away day and night, crossing all manner of terrain in its irrevocable pursuit of justice.  Well, in reality, it doesn’t actually work quite that way.  Sure, the system grinds away, and no doubt intends to perpetuate justice, but the fact remains that it consists not of machines but rather people, real human beings, flesh and blood with all that entails.  In any criminal case, the human element plays a huge and decisive factor.  And it is certainly true that this human factor sometimes results in inequities.  For example, a woman, particularly an attractive woman like Karla Homolka, will often get a better deal than a man would facing the same charges. Some would say that chivalry is not dead; others might term it sexism, plain and simple.  But no matter how you slice this particular onion, these are the facts. Judges, the majority of whom are male, are loathe to send a pretty woman away to prison for a protracted period of time if they can come up with an excuse not to.  The statistics bear this out. And, of course, there are exceptions to this general rule.

There are several factors that influence the drafting and the signing of the plea agreement.  First of all, it’s a back-and-forth process.  First, the prosecution floats a proposed plea agreement to the defendant and his/her defense team.  If the defense is not satisfied, it proposes changes. So then it goes back to the prosecution. Both sides negotiate.  This is called “acting in good faith”; the parties, although fiercely advocating their respective positions, are required to proceed in a civil and professional manner.

There are also purely practical considerations such as the current workload faced by the participants.  How much time do you want to put into this case? How many more important cases are you handling at that particular moment? But in the case of Karla Homolka and Paul Bernardo, it’s safe to assume that there was no other more critical case in all of Canada at that time.  So time was not a big factor. This brings us back to my earlier point: The Crown needed Karla in order to successfully prosecute Paul Bernardo.  Without her, they had no shot at obtaining the murder convictions.

Two quick observations and then we will move on to the “abuse factor” and how it may have affected Karla’s ultimate sentence.

karl11The profound outpouring of rage and frustration on the part of the Canadian public upon learning more about the case during the course of the trial is now legendary. But it is instructive to stand back for a moment and consider what would have happened if the Crown had refused to give Karla the deal they ultimately did and she had gone to trial.  Similarly to Bernardo’s trial, Karla’s proceedings would have been very much in the public eye, whether or not the media gag order was imposed. At the trial, much of the same information that came out at Bernardo’s trial would have been presented: Karla as abuse victim, Karla as good girl gone bad, Karla and her lawyers claiming that Paul Bernardo was the real criminal and that he should have been the one standing trial. Now, when one eschews emotionality and takes a hard look at this case, it becomes clear that the Crown was, to a large degree, stuck between “a rock and a hard place.” They could not afford for Karla to go to trial considering the fact that, notwithstanding her outcome, it would have inserted Paul Bernardo directly into the crosshairs of public consciousness — yet it would have done so without the Crown having sufficient evidence with which to prosecute him. So let’s say Karla went to trial and was convicted of 2nd degree murder in the cases of Leslie Mahaffey and Kristen French. The Crown would then have still needed her testimony to convict Bernardo.  Suppose Karla, through her attorneys, had then refused to comply with the Crown’s needs? The public anger that would have then erupted based on the Crown’s inability to prosecute and convict Bernardo would have dwarfed the ultimate outrage over Karla’s allegedly overly-lenient Plea Agreement. Keep in mind that the legal professionals handling the case were painfully aware of all of these possibilities.  They don’t want the roof to blow off.  Sure, they know that they’re going to take a beating down the road when the truth comes out at the trial, but that beating, to these seasoned professionals, is more akin to a severe paddling than the pummeling they would have sustained had they been unable to take Bernardo to trial.  The parties were undoubtedly very cognizant of the risks they faced. They knew that both sides had to cooperate in good faith. The larger catastrophe of Paul Bernardo escaping prosecution for the murders of Leslie Mahaffy and Kristen French had to be avoided. At all costs. It was as simple as that.

 

The Abuse Issue:

A further factor that influenced the decision to give Karla Homolka a moderately good deal was the physical and psychological abuse that she endured.  The control exercised over her by Bernardo was considered to be Svengali-like in its nature and raises an important question: can (and should) spousal abuse be viewed as a factor in mitigation, and if so, to what degree? Keep in mind that factors in mitigation are in no way exonerative. They simply help to reduce the sentence.

There is no doubt that substantial actual physical abuse occurred.  The ER examination of Homolka in January 1993 reads as follows, (Galligan report, p. 42)

On examination today, Karla is in distress, quite anxious and understandably so. Her eyes reveal raccoon’s eyes, bruising all around the orbits, large contusion to her head with what feels almost like a depressed fracture, although x-rays have ruled this out. She has a subconjunctival haemorrhage in her left eye, which was seen by Dr. Marriott, and she was re-assured. She has several bruises down the left side of her neck, along her arms, with a very large bruise in the upper right arm which is three centimetres by three. About 75% of her legs from mid-thigh down are bruised, quite dramatically and swollen to touch. She cannot move them due to pain. On the right thigh, about 3 cm. above the right knee, there is a puncture wound which she said was caused by Paul Bernardo when he punctured her with a screwdriver. On the left leg, there is a large isolated contusion about 6 inches by 3 inches, quite warm and tender.

urlKarla Homolka suffered one hell of a beating at the hands of Paul Bernardo. It’s hard to see how any reasonably objective observer would doubt that Paul had beaten Karla repeatedly — given his documented history of violent sexual assaults in the Scarborough rapes, his violent assaults on his girlfriend prior to Karla, and the physical evidence with Karla.

So we must ask: what role did the abuse play in affecting Karla’s eventual sentence?

The answer is the abuse became an essential element in the plea bargaining process. Karla’s attorney initially sought full immunity – with the abuse as a key bargaining chip, and the Crown had little choice other than to view the abuse as a strong factor in mitigation for the simple reason, as discussed previously, that Canadian law enforcement did not have enough evidence to arrest and convict Paul Bernardo without Karla’s ongoing cooperation.

To its credit, the Crown does not appear to have at any point considered giving Karla full immunity, and thus there seems to have been no inclination to consider the spousal abuse to be fully exonerative.

In Canada, there was relatively little reaction to the deal when it was first announced, in large part due to the fact that at that time, in July of 1993, the videotapes showing Karla’s active involvement in the sexual crimes (but not the murders) had not yet been turned over to the Crown.  When the videotapes were later found and introduced at trial, a strong wave of anti-Karla sentiment began to build, and with it, the popular perception that she had simply failed to disclose the extent of her involvement to the police.

karl5Crown officials contend, however, that Karla did fully disclose her active participation in the sexual crimes against Kristin French and Leslie Mahaffey from the moment she first approached the authorities, on February 13, 1993.  The Crown, however, chose not to share those details publicly, or otherwise prepare the public for the revelations that would occur at the trial.

Physical and emotional abuse perpetrated by unstable spouses is endemic in our society. It’s impossible to accurately gauge how prevalent it truly is because so much of the time it goes unreported. Karla had literally been abused for years before she finally came forward.

An F.B.I. article entitled: “The Disturbed Mind – Compliant Victims of the Sexual Sadist” provides useful information on this topic.  The article is presented as “a descriptive summary of the experiences of a sample of women who have been consensually involved with criminal sexual sadists.” The article describes “the physical, sexual, and psychological abuse” that seven female victims endured and discusses “the process by which they were transformed from independent, competent women to compliant appendages of their criminally active partners.” This is scary stuff and the article pulls no punches.  The descriptions of the victims’ sufferings are truly horrific:

Physical abuse

All the women suffered physical abuse during their relationship with the sadists. They reported being frequently beaten with fists and other blunt objects. One woman reported that her husband called his arms ‘guns’ and would periodically give her ‘body shots’ or blows to the chest and stomach. Another woman advised that her boyfriend kept her in captivity for 3 days during which he bound her from head to feet in adhesive tape. Hourly, he would stand her upright and strike her viciously in the body, knocking her over. Four of the women suffered broken bones at the hands of their ‘loved ones’.

karl7Five of the women were whipped with leather whips, ropes or belts…  Another woman was suspended by the wrists and whipped with a belt periodically over a number of years.

Four of the women were burned with matches, cigarettes or lighters… Biting, as a means of physical abuse, was reported by all of the women. Painful clamping devices were used on the nipples and labia of five of the respondents.

Six of the women reported that they were strangled manually or by ligature during sexual activities. Most reported either losing consciousness or being on the verge of doing so. Painful bondage was used on all the women…

While all the women advised that some of their injuries were visible to others, only one sought medical assistance. This woman’s husband broke her arm while forcing her to engage in anal sex.

Sexual abuse

All the women were sexually abused by the men. Three victims were forcibly penetrated by large foreign objects. One subject used a 12 cell flashlight and also a long cylindrical piece of wood. Almost invariably these items were inserted anally, so as to cause maximal suffering.

karl4Six of the women reported anal intercourse to be their sadistic partner’s preferred mode of sexual release. Forced fellatio was also reported by all seven women…

Two of the seven women advised that they had been urinated on, and one reported being required to administer enemas to herself. Three of the women were forced to have sex with others; two were raped by friends of the sadists, and one was forced to engage in sexual acts with another woman who had been kidnapped by her husband.

All seven of the respondents agreed that the men were sexually insatiable…

When asked to describe the worst sexual abuse suffered, one woman told being hung by her wrists and whipped to the point of unconsciousness, explaining that this degree of suffering and humiliation enabled her partner to become sexually aroused for vaginal intercourse. During the whippings she was not allowed to cry, scream or plead.

teddyThe article states that the majority of the woman had been sexually, physically and/or emotionally abused as children. All seven women in the study, like Karla, were raised in middle class or upper middle class families. Karla, based on what we know about her upbringing, was not abused as a child. Nothing in her past would seem to explain her compliance with Paul Bernardo’s demands. Of course, the absence of solid evidence that Karla was abused prior to meeting Bernardo does not establish that she was not abused.  We simply do not know. What we do know is that her relationship with Bernardo was progressively abusive, which may have served to gradually render her, in some respects, a “compliant victim.”

Another key difference between Karla and the women depicted in the study is that Karla, unlike the other victims, does not appear to have entered the relationship from a place of weakness or powerlessness. She was the aggressor in their initial sexual encounter; she precipitated their initial act of anal intercourse, and, in the early videos, she seems quite normal and content. Yet, as her relationship with Bernardo progressed, she became increasingly subservient. Since Karla did not seem to share the childhood abuse characteristic common to many “compliant victims of the sexual sadists,” and did not enter the relationship in a weakened state, we struggle to understand why she stuck around for as long as she did “once the game got rough.”

karl10One glaring fact, which may at times have been overlooked in trying to unpack this thorny case, is the extent to which THE DEATH OF HER SISTER TAMMY CHANGED EVERYTHING. It probably provided Bernardo with a ten-ton bludgeon, metaphorically speaking, with which to beat Karla. If she had gone to the authorities after Tammy’s death and simply confessed, she would have been in huge trouble and would have undoubtedly received a protracted prison sentence. Furthermore, if Bernardo had gotten wind of this, he might have had time to destroy the video evidence and Karla, if she had already confessed to accidentally asphyxiating Tammy, would have ended up, at the very least, with an aggravated Manslaughter conviction.

Therefore, it is my belief that after Tammy’s untimely death, Karla “sucked it up” for a very long time. It was only after Bernardo’s abuse had escalated to such a degree that it was approaching but had not quite reached the level of suffering experienced by the female victims in the F.B.I. study (note the apparent screwdriver puncture wound and Karla’s sea of bruises from her mid-thigh on down), that Karla saved her life by going to the authorities.  It was only a matter of time.  Sooner or later Paul Bernardo would probably have killed her, perhaps accidentally, perhaps with malice aforethought. As a result of the stark reality of the final beating and the abject terror she must have experienced, Karla Homolka “read the tea leaves” and turned herself in.  Had she not, we would be dealing with an entirely different story.

Although we will probably never know for sure if Karla killed the two Canadian schoolgirls, or if Paul killed them, or if it was a joint effort on their part, we should, in a sense, be grateful that things have turned out as they have.  If Karla had not gone to the authorities, there is little doubt that Paul Bernardo would have raped and murdered more innocent victims. By turning herself in, Karla brought a halt to the carnage. No matter what we may think about her, the reality is that her decision, self-serving though it obviously was, had the practical effect of bringing the killings to an end.

Heartbreaking Claire Hough San Diego Cold Case Solved 30 Years Later with DNA Evidence

In the world of capital crime, there may be nothing more fascinating than The Cold Case. The term itself conjures up dark, hidden mystery suspended in time yet forgotten by everyone except the family of the victims, the perpetrators, any determined detectives who refuse to throw in the towel and continue working on the case, and of course diehard crime fans who have memories like the proverbial elephant and never forget an unsolved murder.

cla6One of the curious things about The Cold Case is that even if the resourceful detectives do ultimately bring it to closure, not everyone is going to agree that they got it right. Such would seem to be the case with the brutal murder and disfigurement of a lovely 14-year-old-girl named Claire Hough, whose young life came to an end at Torrey Pines State Beach in San Diego on August 24, 1984. It was death by strangulation with, for good measure, her left breast cut entirely away with fingernail marks lashing her body, according to the autopsy report.

 

In an excellent San Diego Union-Tribune article dated October 23rd, Kristina Davis and Lyndsay Winkley skillfully break down the case:

claFor 30 years, investigators worked to unravel the mystery of who killed 14-year-old Claire Hough as she smoked cigarettes and listened to cassettes at Torrey Pines State Beach.

On Thursday, San Diego police said they believe one of the suspected killers was working among them as a criminalist in the same police lab where evidence of the teen’s brutal slaying was examined and stored.

cla10The case was solved largely though DNA matches analyzed in 2012 which established both men’s DNA matched samples taken from the teen’s body. There has apparently never been much other solid evidence pointing a finger at any alleged killers.

According to the authorities, the criminalist in question, Kevin Charles Brown, 62, who retired from the police department in 2002, killed himself this week as officers were closing in to arrest him.

One of the facts which could cast some doubt upon the investigators conclusions is the fact that there is apparently no evidence connecting Brown to the second alleged killer, Ronald Clyde Tatro

“Tatro, is also dead, having drowned in an apparent boating accident in Tennessee in 2011.”

Playing it cool, on Thursday when the case broke, police refused to speculate as to whether the two men had any type of relationship. On the surface, however, “they appeared to lead very different lives.”

cla9For starters, Tatro’s history suggests a possible serial rapist. Not only did he have a lengthy criminal record, but in 1985, one year after Claire Hough’s violent death, Tatro, who was 43 at the time, “was arrested on suspicion of kidnapping and trying to rape a 16-year-old girl in La Mesa, police said. He coaxed her into his van and tried to subdue her with a stun gun, but she screamed and managed to get away.”

This brave teen who refused to be raped and escaped, also managed to give officers Tatro’s license plate number. As police prepared to swoop in, the 16-year-old’s assailant, displaying anything but bravery, slit both his wrists. He got away with pleading to a lesser charge of felony false imprisonment and was sentenced to a mere three years in prison.

Compared to Tatro, Brown’s history is the essence of stability. He worked as a criminalist, first in Mew Mexico for two years, “then for the next 20 years at the San Diego Police Department.” While with SDPD, “he worked in many parts of the lab over the years, from firearms to trace evidence.”

Claire Hough’s death had mystified and frustrated detectives for decades, but what little evidence there is suggested she walked down to the beach that evening to smoke cigarettes and listen to music.

cla4Her body was discovered on a towel under the Old Highway 101 bridge by a passer-by about 5 a.m on the morning after her murder, with a radio, cigarettes and matches nearby.

No one knows for sure why the teen took the short stroll from her grandparents Del Mar Heights home to the beach that fated evening, but her bereaved father reported that she would take similar jaunts down to the bay from her home in Cranston, Rhode Island. In any event, the authorities do not believe there was any coercion involved in her decision to walk down to the Torrey Pines beach. Her grandparents didn’t realize she was missing until 9 am the next morning.

Claire’s family expressed their appreciation to the detectives on Thursday.

“In a way, it doesn’t make any difference who killed her,” her father, Samuel Hough, said from his Rhode Island home. “She’s dead and there’s nothing we can do about that. The important thing for us is what she was and what she became — the fact that she was so positive, so rich, at the time that she died.”

However, Kevin Brown’s widow, Rebecca Brown, is having none of it, claiming this is a clear case of DNA contamination because of her husband’s proximity to the evidence in the Police crime lab.

“The police have hounded my husband all year, and he ended up having a nervous breakdown and killed himself,” Rebecca Brown said Thursday. “They kept hounding him on something he didn’t do. He’s a good, kind, sweet, gentle man.”

cla11San Diego Police Department homicide Capt. Al Guaderrama dismissed Rebecca’s allegations, stating Brown had never been assigned to any part of the Claire Hough investigation and was in no way associated with any of the evidence processed.

“We do not believe that there was any type of contamination in this case at all,” Capn. Guaderrama said. (Well of course not. Even if there was contamination, which is probably not the case here, there’s no guarantee that anyone would report it.)

Most of you reading this post have probably never been in trouble with the law, although a few of you may have been. Having worked with up to 200 criminals over the past 11 years, I can state without reservation that there is no worse feeling than having law enforcement come to your home with a search warrant. Many suspects never fully recover from the shock of hearing that knock on the door, which in some instances is more of a pounding.

Brown’s Chula Vista home was searched on January 9th and I suspect the knock was probably reasonably polite, given his long history of working for SDPD. Rebecca Brown recalls:

“It shocked the whole family.” Investigators seized numerous items: computers, old photo albums, cameras, her mother’s cookbook.

cla2Capn. Guaderrama reports that the DNA match had spurred an exhaustive investigation including interviews around the country, probably mostly having to do with alleged co-killer Tatro. 30-year-old evidence was re-examined.

Although the Captain didn’t specify what precisely it consisted of, he did say several pieces of evidence were found.

After the initial knock/search/seizure, Brown was questioned multiple times throughout the year. So were his family members, friends and neighbors. According to his criminal defense lawyer, Gretchen von Helms, Brown suffered from bouts of anxiety and depression.

Von Helms also stated that Brown passed an independent polygraph test administered by a former police officer. (Of course, polygraph tests are rarely admitted into evidence at trial though they can occasionally play a part at sentencing.

“They haven’t believed him and they’ve kept at it,” his wife said. “They just pushed my husband to an early grave.”

cla15When Rebecca Brown went to work at Mater Dei Catholic High School, where she teaches, last Monday morning, Brown was still in bed. After Rebecca left, he got up, dressed and told his live-in mother-in-law that he had things to do.

cla12He certainly did. His body was found on Tuesday, hanging from a tree at Cuyamaca State Park on Highway 79 near mile marker 7.25, according to Capn. Guaderrama, who has told his widow that no suicide note was found.

Solid DNA evidence, which was presumably present in this case, certainly cannot be taken lightly. What makes me suspect that Brown may well be one of Claire Hough’s co-killers, however, is the fact that under duress, rather than hang on and fight it out at trial, he chose instead to end his life. If he was innocent, he almost certainly would have gone to trial, alleged DNA evidence notwithstanding, wouldn’t he have?

cla16On the other hand, he could have been an unstable personality, but even those types rarely kill themselves when under police duress. Rather, they stew and suffer and complain endlessly.

From my own personal standpoint, I am every bit as comfortable with a case never being solved as I am with definitive closure which I instinctively distrust. But that’s just me. I’m very aware that most people want to place their faith in the “facts” and prefer closure in criminal investigations.

cla19I was probably damaged by going to college and graduate school in the late 1980s when Deconstruction and Post-Structuralism were all the rage and Undecidability was the order of the day. As an old man, I chuckle at what I imbibed at the university back then but it does, alas, seem to have perhaps taken a toll on me.

Although I’m quite certain that each and everyone of these killers had their moments of intense terror and loneliness, I am struck by the fact that some of them seem far more unhappy than others. For example, Aileen Wuornos may have been one of the most unhappy women that every lived. Compared to her, suave Mr. Bundy seems to to be feeling only moderate pain, while the deadly Dahmer appears to be consumed with guilt over his actions. What all of this boils down to is that although serial killers may well shares many basic personality characteristics, they are all different which makes it tough to generalize effectively about them.

Teenage Girl Allegedly Stabs Best Friend 65 Times for Posting Nude Selfie on Facebook

In trying to make sense out of the wobbly world of crime, we’re occasionally confronted by a case both gruesome and strange that makes us shake our heads and ask, “What was he/she thinking?” This comes up frequently in cases involving children whether it’s the schoolyard bullying syndrome or teens doing crazy things like locking their parents in their room and setting the house on fire.

Any of us who have experienced the great pleasure of raising a teenager know that it doesn’t matter if they’re boys or girls – either way as a parent you’ve got to be on your guard because sooner or later Jack or Diane will do something that keeps you awake at night. And then of course there’s the problem of the nervous parent who lies awake at night worrying about what Jack or Diane may do even though they haven’t done it yet.

anel5With girls (and sometimes with boys), you may face the best friend gone wrong syndrome. That’s when Diane and Jill who are really close and share everything suddenly inexplicably quarrel —  maybe over a boy, maybe over another friend or even a remark that is taken as explicitly hurtful.

Painful though such a breakup may be, you generally don’t worry that either your daughter or your daughter’s former friend is going to end up a murderess and that the victim is going to be the other party. But that’s exactly what happened in Sinaloa, Mexico not too long ago ago. Andres Jaurequi of the Huffington Post writes:

A Mexican teen is accused of killing her best friend following a dispute over nude photos on Facebook.

Erandy Gutierrez allegedly stabbed Anel Baez 65 times at the victim’s home in Guamuchil, Sinaloa, on March 19, according to Mexican news site Notus.

The girls, both 16, had once been close, but that relationship deteriorated after Baez posted a “humiliating” naked selfie of herself and Gutierrez to Facebook, according to the New York Daily News.

anel4According to the International Business Times, when Baez uploaded a picture of the two girls both naked, Gutierrez became furious and threatened to “bury” Baez before the year was over.

It must be said that the slayer Gutierrez certainly gave Baez fair warning:

“It may seem that I am very calm, but in my head I have killed you at least three times,” Gutierrez reportedly wrote to Baez in her Twitter account, which has since been deleted.

According to Notus, the prosecutors have stated that Gutierrez has admitted slaying Baez as revenge for her posting the naked selfies.

If we are to believe the victim’s family, however, there is some doubt as to whether the photos ever even existed, according to a Huffington Post translation of the website. And Baez’s friends have stated that they never saw the purported photos on Facebook.

abel2These alleged facts, however, do not prove that the offending selfies never existed and could (I realize this sounds callous) merely result from the victim’s family’s natural desire to present poor deceased Baez as completely blameless in this matter.

Furthermore, Gutierrez’s threatening tweets must be in response to something her former friend did.

abel4What is heartbreaking is that Baez would almost certainly be alive if she hadn’t succumbed to her own desire to bury the hatchet with her former best friend. According to a HuffPost translation of Semana, on March 19th, Baez foolishly and fatally invited Gutierrez to her house with the intention that the two teens would resolve their dispute and become friends again.

This is the moment not unlike when Heather Elvis succumbs to Sidney Moorer’s allurements and gets in her car and drives to the boat landing, all the while texting like a madwoman. This is the moment when the viewing audience turns bone-white and entreats the future victim, “No! Nyet! Nein! Ay no! Don’t do it! Don’t you see…”

Tragically, Anel Baez did not see. At some point after Gutierrez arrived at Baez’s house, she allegedly picked up a kitchen knife and stabbed her former best friend in the back with it up to 65 times.

After that Gutierrez fled the scene and reportedly tried to hide her involvement by grieving with friends. At some point, the authorities learned she had been at Baez’s house. They moved in and arrested Gutierrez at the funeral. The purported slayer is expected to be charged with murder this week.

Since her brutal murder, Anel’s local high school (which was also attended by Erandy) has been hosting lectures and seminars aimed at preventing further similar tragedies, local media reports.

abelNews website Cafe Negro says the ‘therapy’ sessions are being run by rector Juan Eulogio War Liera for a community left ‘sad and outraged’ by the brutal murder.

‘In this community I want to tell you are not alone, we share your pain and anger and can add efforts to overcome the bitter moment,’ the website quotes him as saying.

‘Unity in the family is a way to preserve peace, values​​, tranquility and have a better world.’

If this were a U.S. case, it’s very likely that the 16-year-old Gutierrez would be tried as an adult. In Mexico, however, I think such a barbarism is unlikely. Notus reports that if convicted as a minor, Gutierrez would face a prison term of up to seven years.

Kendrick Johnson Gym Mat Death Case: 9 Suspicious Facts, Federal Investigation Ongoing! (Updated)

Update: Despite proclaiming Kendrick Johnson’s death “accidental” approximately 18 months ago, in the last few months, the Lowndes County Sheriff’s Office has conducted interviews with around two dozen current and former Lowndes High School wrestlers who were on the team on January 10, 2013, the day Johnson disappeared, before being found dead in the rolled up gym mat the following day. The investigation appears to center around one of the wrestling team members, who reportedly confronted Johnson and told him “it ain’t over” regarding a confrontation Johnson had with the former student’s younger brother. This individual is not, however, technically a “target” or a “person of interest” at present. For a detailed update on the case, go to Local, fed probes into gym mat death continue.The Federal re-investigation of  Kendrick Johnson’s gym mat death is also still ongoing.

In an online article, Christina Coleman of Global Grind provides NINE suspicious facts that cast doubt upon the “official” explanation of how Georgia teenager Kendrick Johnson died. Although each of these clues are not necessarily conclusive when viewed in isolation, when considered as a group, the evidence of a cover-up, or at the very least a concerted effort to not find the truth, becomes overwhelming.

As a sort of analytical exercise, I will rate the strength of each piece of evidence when viewed in isolation. A 10 means powerful evidence of foul play, while a 1 means little evidence of the same. Naturally, many of you may disagree with my ratings.

1) The Gym Mat — Rating: 9 to 10

kkKendrick Johnson measured 19 and 1/2 inches across the shoulders. How in the world could he fit himself (unless he was stuffed into the opening by another party) into an opening that was only 14″ in diameter? Furthermore, if he had fallen in and gotten stuck reaching to retrieve his shoes, his legs would be sticking out. The sheriff’s office claims that Kendrick fell headfirst into the mat.

 

 

 

2) The Blood Spatter — Hard to rate. Perhaps a 6 or an 7…

kk3There were blood spatters on a nearby wall and a bloody tissue near the bathroom that did not belong to Kendrick. The wall samples tested inconclusive (whatever that means). The authorities have stated that forensic testing does not support a struggle or a fight. Lt. Stryde Jones stated that since there are 3,000 students at the school, the chances of determining whose blood it is are slim.

 

 

 

3) The Shoes — Rating: Perhaps a 6. The evidence of a coverup is strengthened by the fact the “red matter” was never evaluated.

kk4A pair of shoes splattered with “red matter” were found on the floor outside of the rolled-up mat in which Kendrick was stuck. The authorities, in their off-hand manner, claimed the “red matter” wasn’t blood and never had it tested.

 

 

 

4) The Sweatshirt — Rating: Same as above. A 6. The fact the evidence was ignored  is cause for suspicion.

A sweatshirt found nearby also appears to have been speckled with blood. Naturally, it too was not included in the evidence.

 

5) The Fight — Rating:  6 or 7.

kk6Although Kendrick has been described as a kind, smart and responsible teenager with no enemies, he did get into a hassle with a senior varsity athlete when he was a freshmen. Kendrick reportedly got the best of the senior in a bout of verbal jousting and was then attacked by the senior but little damage was done. The authorities reportedly tried to question the senior after Kendrick’s death, but through his parents, he stated that he preferred not to make a statement. The surveillance video reportedly does not show the boy in the gym at the time of Kendrick’s death.

 

6) The Death Threat — Rating: This is a perfect 10 which may explain why it was ignored by the detectives. How many people are in on this coverup, anyway?

kk7Kendrick’s best friend, 16 year-old Soloman Arrington, reported to the authorities that he received threats on Facebook mere hours after he learned that Kendrick was dead. Soloman’s mother told media that the message stated that her son  would “end up in a body bag.” She reported this information to a detective from the Lowndes County Sheriff’s Office but, according to Soloman’s mother, he was singularly disinterested.

 

 

7) The Second Autopsy — Rating: Another perfect 10.

The County Medical Examiner performed the initial autopsy and reported that Kendrick died of asphyxiation, which of course supports the notion that the teen fell into the rolled-up gym mat and smothered. However, after obtaining the court order to have Kendrick’s body exhumed and re-examined in May of this year, Dr. William Anderson, a private pathologist hired by the family, discovered that Kendrick’s death was caused by “unexplained, apparent non-accidental blunt force trauma,” not from asphyxiation. In other words, someone hit him really hard.

Dr. Anderson also reported that he detected hemorrhaging on the right side of Kendrick’s neck.

 

8) The Body and the Missing Organs — Rating: Yet another perfect 10.

kk8The second autopsy also revealed that Kendrick’s body had been stuffed with newsprint and old magazine pages where his internal organs should have been. The GBI (Great Bodily Injury) spokesperson, Sherry Lang, said the actual internal organs were placed in Kendrick’s body before it was sent to the funeral home. Funeral home’s owner Antonio Harrington stated that his firm never received the teen’s organs, and claimed they were “discarded by the prosector.” It would have been helpful if Harrington had reported this before Kendrick was buried the first time.

 

9) The Video — Rating: An 8 or 9 but hard to rate.

kk9Police claim that the surveillance video which was released on Wednesday has not been edited. However, the video is full of gaps. One clip shows Kendrick in the gym. A second clip shows him walking in and then running out of the frame. In both clips students suddenly appear with no indication how they got there. A third clip, which shows students playing in the gym, and the mats where Kendrick’s body was found, is blurry and does not show the top of the gym mats.

One doesn’t need to be a conspiracy theorist or to otherwise stretch things to be pretty darned sure that a coverup is in place. Since a Federal investigation is now underway, you can be certain that the “county boys” are beginning to sweat a little. One friend of All Things Crime Blog suggested in a tweet that the connections between the sheriff’s department and the school authorities should be carefully examined.

If one assumes that a cover-up is in place, a position I am certainly leaning toward (along with millions of other Americans), the question become “why?” Who is trying to protect whom? If there is a conspiracy in place to coverup the truth about Kendrick’s death, the participants would seem to include — at a minimum — law enforcement officials, school authorities and the Medical Examiner’s office.

This is the fifth in our series of posts by Tyler who received several life sentences for an armed robbery he took part in when he was 17. No one was injured in the “stick-up” but that did him no good when it came to sentencing.

Hardtimin” Holidays is what I call this time of year. Speaking from a prisoner’s perspective, the winter season is always the toughest. Every phone-call home, every visit, every letter is felt just a little deeper during this time; even the last eleven years of these winters spent in a small concrete cell has not changed that. Now is when I feel the most…isolated. Loneliness and separation are held close and reminders of better days become impossible to escape.

PRISONERSYup – Hardtimin’ is in full swing, and crazily, it is my favorite time of year.

Halloween, Thanksgiving, Christmas and New Years have always been my favorites. Some of my fondest memories are of times spent searching for the best candy houses, looking at Christmas lights, turkey dinners or kissing a girl on New Year’s Eve. Days of skiing and snowboarding, love and heartfelt laughter – these were periods filled with family and friends – those I love. Even as I write a smile forces itself upon my face.

When spent far from home, however, surrounded by high walls, tall gates and heavy locks in a lonely and barren institution, these memories act as both salve and sword.

How is it that when I remember Thanksgiving Days of good food and company and family it hurts? How do dreams of love, comfort and happiness leave me waking with a residue of tears? How can a wish feel like a punch to the gut? The wind is knocked from me when I close my eyes and wish for a wood-burning fire, or to smell the aroma of pines at a Christmas Tree lot? My wishes are of holidays free with family and friends living happy and healthy, productive and successful.

abcd2Whatever the wish or memory or dream, it all seems to hurt more this time of year.

But…it is because of these heightened emotions that I say this time of year is still my favorite. Nostalgia is at its highest mark during the winter. My memories are painful, but the pain is sweet and I am grateful for it.

I have come to find that the majority of men in here with me do not have these types of memories. (Trust me when I say that this makes me feel all the dumber for becoming so lost.) Most of my fellow inmates do not know about pine trees and cabins, snow and sledding. When abcd4a winter desert wind breaths across their faces they do not close their eyes and think of decorations, laughter and love.

So, whatever pain I feel from a past that is gone or hurt that comes from an unknown future, I am lucky for what I have had and still have – Mom, Dad, brothers, sister, aunts, uncles, cousins and friends – supportive and loving and caring, yesterday, today and tomorrow.

The very same holiday memories that hurt, keep me going.

To complicate matters, Morrison’s a loner. Until now this has been an asset in his line of work, but this job is too big, too perilous to work alone. So he’s forced to depend on an unlikely array of people:  a Guatemalan migrant worker here to avenge the death of his sister; a retired Coast Guard Admiral who misses the thrills of his former life; a small-time New York hood on the lam from the mob; and the beautiful and seductive girlfriend of a sleazy hustler.

It all plays out in Mangrove Bay. The end of the road. An outpost on the southern tip of Florida, beyond which lies nothing but endless swamp and danger.

A Conversation with Philip Cioffari,

author of DARK ROAD, DEAD END

 Q: Why did you decide to use the illegal trade of exotic animals as the premise of your latest book?

A: I was appalled to learn that the trade in exotic and endangered species is a multi-billion dollar industry. It stands as the world’s third largest organized crime—after narcotics, and arms running. In the state of Florida, it is second only to the illicit trade in narcotics. Despite an international ban on such trafficking, there are many “rogue” nations that do not enforce the ban and that turn a blind eye towards those who violate it. And to be sure, world-wide, there is no shortage of those willing to engage in wildlife poaching and smuggling. One reason for this is the lucrative rewards of such activity—as one U.S. Customs agent put it, “Pound for pound, there is more profit for smugglers in exotic birds [and other wildlife] than there is in cocaine.”

Q: Is it really that hard to police this kind of criminal activity?

Another appeal to the criminal mind is the low risk of being apprehended, this a consequence of the fact that most customs agencies are understaffed and over-worked and must, of necessity, turn their attention to higher-profile crimes, like the trade in narcotics and guns.

Q: How does this happen?

The way it works is this: animals are poached from all over the world, smuggled illegally out of their respective countries, then shipped thousands of miles via land and sea, and ultimately smuggled into the country of destination.

Q: Who is buying these animals?

A: The U.S. and China are the two largest consumers of such contraband.

Q: You are better known for your literary works, what inspired you to go the noir route this time?

A: I wanted to shed some light on this situation, to call attention to it and—because I’m a writer of fiction—do so in as entertaining a way as possible, hence the noir suspense/thriller format of this novel.

Pulchritude is a word you don’t hear much anymore. When I have heard it used it’s generally been in reference to “female pulchritude” which I always assumed meant “female physiognomy” or feminine physique, but in looking it up online it’s simple a middle English word derived from the Latin and it simply means “beautiful”. Or as one proponent of pulchritude put it, “My girlfriend is the most pulchritudinous woman in the woman in the world.”

However, after deep thought, it seems to me that pulchritude could be applied to both sexes not to mention transgender people. Thus, if a man and a woman make beautiful music together we could say that pulchritude is meeting pulchritude.

neg5All of this is a roundabout and not very clever way of getting around to the fact that there seems to be an awful lot of pulchritude meeting pulchritude at American high schools these days, the only problem being that the pulchritudinous females are invariably rather attractive teachers generally ranging in age from 24 to 32 while the pulchritudinous dudes are always either 16 or 17. Every darned time this seems to result in somebody, generally the boy, letting the cat out of the bag. Then the teacher loses her job, gets arrested, is shamed and humiliated, and very likely goes to jail or prison.

It seems clear that no matter how wonderfully pulchritudinous the 16/17 year old boys appear in the eyes of the older women, it’s just not worth it, yet these these desiring ladies just don’t seem to be able to stop themselves.

neg14Just recently on Huff Crime News, there was a story about Ashley Zehnder, a bespectacled 24-year-old biology teacher and assistant cheerleading coach at Pasadena High School Pasadena, Texas who faces a felony charge for having an improper relationship with an under-aged male member of the cheer squad, according to Click2Houston.com.

Oddly enough, Ashley appears to have inadvertently turned herself in by complaining to the school authorities about a naked selfie of herself that began circulating among the students. Oh Jesus, every time you take a nude picture of yourself with your cell phone and send it out into cyber-space you are taking one king-hell risk.

NegBut the new “mature woman — younger fella” story I want to talk about briefly concerns the case of  a rather interesting former Irish college hoopster and recently terminated high school basketball coach in NYC named Megan Mahoney. Andres Jauregui of Huffington Post writes:

A former basketball coach and gym teacher at a prestigious New York City high school faces statutory rape charges for her alleged sex abuse of a male student.

Megan Mahoney, 24, was arrested Monday for allegedly having regular sexual contact with the same 16-year-old student over a period of more than two months beginning in late October 2013, the Staten Island Advance reports.

neg9Due to law enforcement’s habit of counting each discrete unlawful act as a separate charge,  Mahoney faces 30 counts of statutory rape. According to the New York Post, court papers assert that Mahoney had sex with the teen “on numerous occasions, that is at least two times per week during the period.”

Just to make it worse, she’s also charged with four counts of “criminal sexual act” because of allegedly engaging in mutual oral sex with the boy “at least two times per month during said period.”

As a result of her impropriety, Mahoney has wrecked her career. She resigned from Moore Catholic High School in Staten Island, where she was a gym teacher and an assistant coach for the women’s basketball team.

According to the investigators, some of the illicit encounters occurred on school grounds. In August, in an interview with the New York Post, the boy stated that the relationship began after Mahoney allegedly approached him in the gym, struck up a conversation and offered to coach him in basketball.

“We would just drive around and [do it] in the car,” said the boy.

neg11And as is sometimes the case, there’s another authority figure in the mix, Richard Postiglione, the Moore Catholic High School athletic director, who was investigated for allegedly failing to report sex abuse accusations against not only Mahoney but also another female teacher at the school.

Based on her pulchritude and strapping physiognomy, it is not surprising that Mahoney was a student athlete who played basketball at Wagner College and later at Fordham University before becoming a coach and P.E. teacher.

neg13This one depresses me. Unlike the recent Louisiana sex-threesome-with-teen ladies, Shelley Dufresne and Rachel Respess, who although attractive look rather staged and neurotic neg10to my experienced eye, Mahoney looks hale, hearty and like she’d be lots of fun to get to know. She looks like she was a battler on the court in the best Irish New York tradition, like she very likely gains and loses poundage regularly, and like she doesn’t mind the sun. In short, a “gamer” in every sense of the term.

So why has she also chosen to wreck her life? Sure, the pulchritudinous teen was undoubtedly attractive, at least to her eye, but so what? If we all had a dollar for every attractive kid roaming around around our high schools, we could all probably retire. Because this syndrome appears to be becoming more and more of a social problem, it seems steps need to be taken to keep the problem from arising in the first place. Young vibrant women like Megan Mahoney (or even the wan Ms. Dufresne and Ms. Rachel) should not be throwing their futures away over forbidden fruit. And why does this forbidden fruit seem to be so deucedly attractive to so many young female teachers? I don’t get it and can only shake my head in confusion…
